Book excerpt: The "homeland" security mission of the Department of Homeland Security (DHS) is paradoxical: Its mission space is uniquely focused on the domestic consequences of security threats, but these threats may be international in origin, organization, and implementation. The DHS is responsible for the domestic security implications of threats to the United States posed, in part, through the global networks of which the United States is a part. While the security of the U.S. air transportation network could be increased if it were isolated from connections to the larger international network, doing so would be a highly destructive step for the entire fabric of global commerce and the free movement of people. Instead, the U.S. government, led by DHS, is taking a leadership role in the process of protecting the global networks in which the United States participates. These numerous networks are both real (e.g., civil air transport, international ocean shipping, postal services, international air freight) and virtual (the Internet, international financial payments system), and they have become vital elements of the U.S. economy and civil society. Export Control Challenges Associated with Securing the Homeland found that outdated regulations are not uniquely responsible for the problems that export controls post to DHS, although they are certainly an integral part of the picture. This report also explains that the source of these problems lies within a policy process that has yet to take into account the unique mission of DHS relative to export controls. Export Control Challenges Associated with Securing the Homeland explains the need by the Department of Defense and State to recognize the international nature of DHS's vital statutory mission, the need to further develop internal processes at DHS to meet export control requirements and implement export control policies, as well as the need to reform the export control interagency process in ways that enable DHS to work through the U.S. export control process to cooperate with its foreign counterparts.

This book was released on 2017-08-04 with total page 48 pages. Available in PDF, EPUB and Kindle. Book excerpt: " The U.S. government controls the export of sensitive defense and dual-use items (having both military and commercial use). The five agencies primarily responsible for export control enforcement-the Departments of Commerce, Homeland Security (DHS), Justice, State and the Treasury-conduct inspections and investigations, and can levy punitive actions against violators. A challenging aspect of export control enforcement is the detection of illicit transshipments-the transfer of items from place of origin through an intermediary country to an unauthorized destination, such as Iran. In 2010, the President announced reforms to the U.S. export control system to address weaknesses found by GAO and others. GAO was asked to address how the export control enforcement agencies allocate resources, as well as the challenges they face and the potential impact of export control reform on enforcement activities. GAO reviewed documents and met with enforcement agency officials as well as with U.S. and foreign government and company officials in Hong Kong, Singapore, and the United Arab Emirates, which have a high volume of trade and have been identified as potential hubs for illicit transshipments. Available in PDF, EPUB and Kindle. Book excerpt: International trade plays an enormous role in economic growth and prosperity. This activity can also be used to transfer military equipment, knowledge, and technology to hostile governments and transnational terrorist and criminal organizations seeking to attack and destroy their enemies. The U.S. and other countries have used economic sanctions such as export controls to try to restrict and eliminate the transfer of weapons and financial assets to these governments and organizations. This work examines how the U.S. has attempted to restrict the export of national security sensitive equipment, finance, knowledge, and technology since World War II with varying degrees of success and failure. It also examines how multiple U.S. Government agencies, nongovernmental organizations, and international government organizations seek to influence U.S. international trade, foreign, and security policies while concluding that some export controls are essential for promoting and defending U.S. national security interests.

Book Synopsis Law and the Arms Trade by : Laurence Lustgarten
Download or read book Law and the Arms Trade written by Laurence Lustgarten and published by Bloomsbury Publishing. This book was released on 2020-09-03 with total page 504 pages. Available in PDF, EPUB and Kindle. Book excerpt: This ground-breaking book offers an extensive legal analysis-grounded in public, EU, and international law-of arms trade regulation, integrated with insights drawn from international relations. The sale of weapons and related technologies is, globally, one of the most politically controversial and ethically contentious forms of commerce. Intimately connected with sustaining repressive governments and violations of international human rights and humanitarian law, arms exports are also a central element in the economic and strategic policies of the governments of all large industrial states. They have also been the source of abundant corruption, and of serious challenges to the norms and effectiveness of constitutional accountability in democratic states. On paper, the arms trade is heavily regulated: national legislation and international treaties are in place which purport to prohibit certain transactions and limit others. Yet despite its importance, legal and international relations scholarship on the subject has been surprisingly limited. This book fills this gap in the literature by examining and comparing the export control regimes of eight leading nations - USA, Russia, the UK, France, Germany, Sweden, China, and India - with chapters contributed by leading experts in the field of law and international relations.
