Available in PDF, EPUB and Kindle. Book excerpt: It is the early fall of 1755 in the backcountry of Virginia. The British army has suffered a stunning defeat at the hands of the French and their Indian allies in the opening battle of the French and Indian War, leaving the frontier in flames and open to attacks from the enemy. William Kay, a young minister well-known to the colonial establishment for his years long stand against a powerful planter and vestryman bent on revenge, is murdered. Three of Kay’s slaves are accused and swiftly condemned to the brutal form of justice reserved for the enslaved, while another man who had threatened Kay’s life disappears from the scene. When the colonial governor and officials aligned with him suppress the news of the unprecedented crime and the court record of the slave trial, the killing of Reverend Kay becomes lost to history––until now.

Book excerpt: Explore the controversial legal history of the formation of the United States Prestatehood Legal Materials is your one-stop guide to the history and development of law in the U.S. and the change from territory to statehood. Unprecedented in its coverage of territorial government, this book identifies a wide range of available resources from each state to reveal the underlying legal principles that helped form the United States. In this unique publication, a state expert compiles each chapter using his or her own style, culminating in a diverse sourcebook that is interesting as well as informative. In Prestatehood Legal Materials, you will find bibliographies, references, and discussion on a varied list of source materials, including: state codes drafted by Congress county, state, and national archives journals and digests state and federal reports, citations, surveys, and studies books, manuscripts, papers, speeches, and theses town and city records and documents Web sites to help your search for more information and more Prestatehood Legal Materials provides you with brief overviews of state histories from colonization to acceptance into the United States. In this book, you will see how foreign countries controlled the laws of these territories and how these states eventually broke away to govern themselves. The text also covers the legal issues with Native Americans, inter-state and the Mexico and Canadian borders, and the development of the executive, legislative, and judicial branches of state government. This guide focuses on materials that are readily available to historians, political scientists, legal scholars, and researchers. Resources that assist in locating not-so-easily accessible materials are also covered. Special sections focus on the legal resources of colonial New York City and Washington, DC—which is still technically in its prestatehood stage. Due to the enormity of this project, the editor of Prestatehood Legal Materials created a Web page where updates, corrections, additions and more will be posted.
Download or read book Free Exercise written by Chris Beneke and published by Oxford University Press. This book was released on 2024-09-24 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof." Those sixteen words, scratched on parchment in 1789, open the U.S. Constitution's First Amendment. From this spare expression, numberless interpretations have been drawn. The Supreme Court has been vigorously debating the meaning of this text for decades. Legions of students, law clerks, and historians have also dedicated themselves to the task. It has become something of an American pastime. Because of that work, an astounding variety of activities in modern America-from prayer after football games and Bible reading in classrooms, to funding for private religious schools and company healthcare policies, the baking of wedding cakes and the display of the Ten Commandments-have been alternately sanctioned, prohibited, or modified. Free Exercise is an innovative contribution to both United States constitutional history and the history of religious toleration in the United States. It traces the routes by which Americans arrived at the First Amendment's religious clauses, the cultural currents that shaped their meaning, and the consequences that flowed from them. The book also demonstrates how white women, African Americans, Jews, Roman Catholics, and nonbelievers expanded the application of religious liberty-and illuminated its boundaries. Each chapter demonstrates how protections for religious freedom were forged from both vague memories and intimate experiences, an emergent respect for individual autonomy and a refusal to materially alter the condition of women and the enslaved. Subsequent chapters examine their relationship to memories of religious violence, free market practices, religious civility, gender and racial exclusion, and unbelief. Each probes what America was at the time and what it was becoming. Free Exercise sheds light on this audacious and deeply flawed effort to reconcile liberty, faith, and equality.
