Book excerpt: Immigration promises to be one of the most important issues for Canada, Australia and the United States in the new millennium, and it raises a fundamental question: What type of newcomer should be admitted? Until after World War II, the United States, Canada and Australia took in almost all the immigrants who could get to their shores. However, now in the new millennium immigration has become more restricted through complex systems that favors skills, capital assets and globalized economies. This study examines an immigration policy that was designed in all three countries to build up the skill and human capital of migration flows, and will help broaden the base of knowledge concerning skilled immigration and economic flows of people, by examining the Investor/Entrepreneurial Programs in Canada, Australia and the United States. This study will compare the success and failure of these programs. It will discuss the decision making motives of the immigrants who took advantage of these programs in all three countries. There are very few studies so far that have examined the rationale behind the decision the entrepreneurs/investors admitted into these programs make to start the type of businesses they actually start, and the final destination of choice. The focus so far, has mainly been on why the business immigration program exists, and what the general economic and social impact in any given area has been. This study will fill that void somewhat. It is clearly a stepping stone from which advanced studies can use to delve deeper into the opportunities and pitfalls, that immigration policies based on economic factors can, and do face.

Participants are required to invest $1 million in a business that is to create at least 10 jobs--or $500,000 for businesses located in an area that is rural or has experienced unemployment of at least 150 percent of the national average rate. Upon meeting program requirements, immigrant investors are eligible for conditional status to live and work in the United States and can apply to remove the conditions for lawful permanent residency after 2 years. This book examines U.S. Citizenship and Immigration Services (USCIS) efforts under the EB-5 Program to work with interagency partners to assess fraud and other related risks; address any identified fraud risks; and increase its capacity to verify job creation and use a valid and reliable methodology to report economic benefits. This book also review the EB-5 Adjudications Policy Memorandum, which is the guiding document for USCIS administration of the EB-5 program.

It begins with a review of the aims and history of the Program and then discusses the needs of Program investors and investees. Topics covered include the capital needs of SMEs, the SME risk capital markets in Canada, the factors that attract immigrant investors to the Program, and the types of investment vehicles that are appropriate. The report ends with recommendations for designing a more effective Program, including the resolution of conflicting objectives of investors and investees, the structure and management of a proposed new Program, and marketing and regulation under the new Program. The appendix includes a review of the risk/reward cycle for patient risk capital and an outline of other options considered for a new Program.
