Book excerpt: With the ongoing evolution of the digital society challenging the boundaries of the law, new questions are arising – and new answers being given – even now, almost three decades on from the digital revolution. Written by a panel of legal specialists and edited by experts on EU Internet law, this book provides an overview of the most recent developments affecting the European Internet legal framework, specifically focusing on four current debates. Firstly, it discusses the changes in online copyright law, especially after the enactment of the new directive on the single digital market. Secondly, it analyzes the increasing significance of artificial intelligence in our daily life. The book then addresses emerging issues in EU digital law, exploring out of the box approaches in Internet law. It also presents the last cyber-criminality law trends (offenses, international instrument, behaviors), and discusses the evolution of personal data protection. Lastly, it evaluates the degree of consumer and corporate protection in the digital environment, demonstrating that now, more than ever, EU Internet law is based on a combination of copyright, civil, administrative, criminal, commercial and banking laws.

Bringing some certainty to this very dynamic environment are the legal foundations supporting the free flow of information over the Internet. New lawyers, lawyers new to information and Internet law, lawyers updating their knowledge on the latest statutes and cases, and lawyers desiring a U.S. - EU comparative legal perspective are among the audiences for this single resource on information and Internet law. This book, used at law schools in the U.S. and Europe, is current to July 2020 and serves as volume 1 of a two-volume set. It provides insight by looking at current statutes, regulations, and directives in the United States and Europe. It discusses and identifies issues raised by the latest U.S. and EU cases on protection of information and use of the Internet, starting with a risk and standards-based approach to this area of law. The areas of information law addressed are: privacy, information security, and data protection law, unlawful data disclosures through cybercrime and data breach, and lawful data disclosures related to messaging and surveillance. The areas of Internet law addressed are: access, jurisdiction, speech, intermediary liability, intellectual property, and e-commerce through electronic and website agreements. Bringing a unique perspective to explain a complex topic, the author has written numerous books on legal privacy and technology and legal history, lectures and writes extensively on the latest developments in technology law, and has long lived and worked in both of these jurisdictions. This book is the result of those many years of experience and insight.

Book excerpt: Since the second edition (2010) of this invaluable book – primary texts with expert article-by-article commentary on European data protection, e-commerce and information technology (IT) regulation, including analysis of case law – there has been a marked shift in regulatory focus. It can be said that, without knowing it, EU citizens have migrated from an information society to a digital single market to a data-driven economy. This thoroughly revised and updated third edition pinpoints, in a crystal-clear format, the meaning and application of currently relevant provisions enacted at the European and Member State levels, allowing practitioners and other interested parties to grasp the exact status of such laws, whether in force, under construction, controversial or proposed. Material has been rearranged and brought into line with the vibrant and constantly shifting elements in this field, with detailed attention to developments (most new to this edition) in such issues as the following: · cybersecurity; · privacy rights; · supply of digital content; · consumer rights in electronic commerce; · Geo-blocking; · open Internet; · contractual rules for online sale of (tangible) goods; · competition law in the IT sectors; · consumer online dispute resolution; · electronic signatures; and · reuse of public sector information. There is a completely new section on electronic identification, trust and security regulation, defining the trend towards an effective e-commerce framework protecting consumers and businesses accessing content or buying goods and services online. The contributors offer a very useful and practical review and analysis of the instruments, taking into account the fluidity and the transiency of the regulation of these very dynamic phenomena. This book will be quickly taken up by the myriad professionals – lawyers, officials and academics – engaged with data protection, e-commerce and IT on a daily basis.

Book excerpt: Internet Intermediaries and Copyright Law' aims to analyse whether the European Union (EU) legal framework on copyright law and intermediaries is future-proof. All forms of online communications and interactions between people and companies on the Internet are facilitated by intermediaries ? service providers whose decisions and policies have a shaping effect on the Internet, its users and the information shared on it. Today, because such intermediaries employ technologies that go well beyond the mere transmission and storage of information into new realms, potentially disrupting existing business models, a rethinking of existing relevant law is called for. The legal analysis and recommendations in this book put the topic of intermediary liability in the perspective of copyright law and offer a vision on how to regulate that liability.

Book excerpt: This book outlines and analyses the legislative activity of the Union in an area which is currently experiencing exponential growth in terms of both commercial activity and legal significance. The scope of the book is current, pending and proposed Internet-related law on contracts, copyright, data protection, commercial communications, financial services, electronic cash and electronic signatures. John Dickie argues that the Union is in the process of displacing Member State autonomy in the regulation of the Internet. Within that frame, it is argued that there is a lack of focus on the individual in the electronic marketplace and a lack of co-ordination between relevant legislative instruments. This book will be of interest to all those engaged with Union and Internet law, including lawyers, policy-makers and academics.

Available in PDF, EPUB and Kindle. Book excerpt: This monograph examines how European Union law and regulation address concentrations of private economic power which impede free information flows on the Internet to the detriment of Internet users' autonomy. In particular, competition law, sector specific regulation (if it exists), data protection and human rights law are considered and assessed to the extent they can tackle such concentrations of power for the benefit of users. Using a series of illustrative case studies, of Internet provision, search, mobile devices and app stores, and the cloud, the work demonstrates the gaps that currently exist in EU law and regulation. It is argued that these gaps exist due, in part, to current overarching trends guiding the regulation of economic power, namely neoliberalism, by which only the situation of market failure can invite ex ante rules, buoyed by the lobbying of regulators and legislators by those in possession of such economic power to achieve outcomes which favour their businesses. Given this systemic, and extra-legal, nature of the reasons as to why the gaps exist, solutions from outside the system are proposed at the end of each case study. This study will appeal to EU competition lawyers and media lawyers.
