Available in PDF, EPUB and Kindle. Book excerpt: America is the most punitive nation in the world, incarcerating more than 2.3 million people—or one in 136 of its residents. Against the backdrop of this unprecedented mass imprisonment, punishment permeates everyday life, carrying with it complex cultural meanings. In The Culture of Punishment, Michelle Brown goes beyond prison gates and into the routine and popular engagements of everyday life, showing that those of us most distanced from the practice of punishment tend to be particularly harsh in our judgments. The Culture of Punishment takes readers on a tour of the sites where culture and punishment meet—television shows, movies, prison tourism, and post 9/11 new war prisons—demonstrating that because incarceration affects people along distinct race and class lines, it is only a privileged group of citizens who are removed from the experience of incarceration. These penal spectators, who often sanction the infliction of pain from a distance, risk overlooking the reasons for democratic oversight of the project of punishment and, more broadly, justifications for the prohibition of pain.

Book excerpt: International law has long differentiated between international and non-international armed conflicts, traditionally regulating the former far more comprehensively than the latter. This is particularly stark in the case of detention, where the law of non-international armed conflict contains no rules on who may be detained, what processes must be provided to review their detention, and when they must be released. Given that non-international armed conflicts are now the most common form of conflict, this is especially worrying, and the consequences of this have been seen in the detention practices of states such as the US and UK in Iraq and Afghanistan. This book provides a comprehensive examination of the procedural rules that apply to detention in non-international armed conflict, with the focus on preventive security detention, or 'internment'. All relevant areas of international law, most notably international humanitarian law and international human rights law, are analysed in detail and the interaction between them explored. The book gives an original account of the relationship between the relevant rules of IHL and IHRL, which is firmly grounded in general international law scholarship, treating the issue as a matter of treaty interpretation. With that in mind, and with reference to State practice in specific non-international armed conflicts - including those in Sri Lanka, Colombia, Nepal, Afghanistan, and Iraq - it is demonstrated that the customary and treaty obligations of States under human rights law continue, absent derogation, to apply to detention in non-international armed conflicts. The practical operation of those rules is then explored in detail. The volume ends with a set of concrete proposals for developing the law in this area, in a manner that builds upon, rather than replaces, the existing obligations of States and non-State armed groups.

Available in PDF, EPUB and Kindle. Book excerpt: Built around the experiences of older prisoners, Punished for Aging looks at the challenges individuals face in Canadian penitentiaries and their struggles for justice. Through firsthand accounts and quantitative data drawn from extensive interviews, this book brings forward the experiences of federally incarcerated people living their "golden years" behind bars. These experiences show the limited ability of the system to respond to heightened needs, while also raising questions about how international and national laws and policies are applied, and why they fail to ensure the safety and well-being of incarcerated individuals. In so doing, Adelina Iftene explores the shortcomings of institutional processes, prison-monitoring mechanisms, and legal remedies available in courts and tribunals, which leave prisoners vulnerable to rights abuses. Some of the problems addressed in this book are not new; however, the demographic shift and the increase in people dying in prisons after long, inadequately addressed illnesses, with few release options, adds a renewed sense of urgency to reform. Working from the interview data, contextualized by participants' lived experiences, and building on previous work, Iftene seeks solutions for such reform, hich would constitute a significant step forward not only in protecting older prisoners, but in consolidating the status of incarcerated individuals as holders of substantive rights.

How can minimum standards designed to protect labor rights be implemented in a world in which national labor law is more and more at the mercy of international forces beyond its control? The contributors to this volume argue that international agreements and institutions are of central importance if labor rights are to be protected in a globalized economy, exploring some of the options that are open to governments, civil society, and the labor movement in the years ahead.

Book excerpt: Originally published in 1974 and the recipient of the Denis Carroll Book Prize at the World Congress of the International Criminology Society in 1978, Thomas Mathiesen’s The Politics of Abolition is a landmark text in critical criminology. In its examination of Scandinavian penal policy and call for the abolition of prisons, this book was enormously influential across Europe and beyond among criminologists, sociologists and legal scholars, as well as advocates of prisoners’ rights. Forty years on and in the context of mass incarceration in many parts of the world, this book remains relevant to a new generation of penal scholars. This new edition includes a new introduction from the author, as well as an afterword that collects contributions from leading criminologists and inmates from Germany, England, Norway and the United States to reflect on the development and current state of the academic literature on penal abolition. This book will be suitable for academics and students of criminology and sociology, as well as those studying political science. It will also be of great interest to those who read the original book and are looking for new insights into an issue that is still as important and topical today as it was forty years ago.

Available in PDF, EPUB and Kindle. Book excerpt: This is the first book to provide a comprehensive historical-geographical lens to the development and evolution of correctional institutions as a specific subset of carceral geographies. This book analyzes and critiques global practices of incarceration, regimes of punishment, and their corresponding spaces of "corrections" from the eighteenth to twenty-first centuries. It examines individuals' experiences within various regulatory regimes and spaces of punishment, and offers an interpretation of spaces of incarceration as cultural-historical artifacts. The book also analyzes the spatial-distributional geographies of incarceration, particularly with respect to their historical impact on community political-economic development and local geographies. Contributions within this book examine a range of prison sites and the practices that take place within them to help us understand how regimes of punishment are experienced, and are constructed in different kinds of ways across space and time for very different ends. The overall aim of this book is to help understand the legacies of carceral geographies in the present. The resonances across space and time tell a profound story of social and spatial legacies and, as such, offer important insights into the prison crisis we see in many parts of the world today.
