Au travers de cette thèse, l'auteur tente de démontrer l'existence de catégories spéciales de fraudes venant se « juxtaposer » à la théorie générale tout en lui dérogeant. En analysant minutieusement les caractères juridiques de chaque pratique de fraude, il tente d'effectuer une classification de l'ensemble de ces pratiques dans des catégories fixes, à régimes plus ou moins invariables, déduites soit de la loi, soit de la jurisprudence, soit des deux à la fois, dans le cadre d'une étude comparée entre les droits français et libanais, celui des principaux pays arabes et le droit musulman. Tout en offrant un certain « guide » en la matière permettant au lecteur d'examiner d'une façon détaillée presque tous les cas de fraude, cette étude présente la notion de fraude comme une notion protéiforme et propose ainsi une nouvelle théorie des fraudes spéciales venant compléter la théorie générale.
