The statutory language intended to ensure equal opportunity to all individuals is now interpreted as authorizing both public and private employers to adopt preferential policies that benefit designated groups based on race and gender. Much the same transformation has occurred in federal contract programs: President Kennedy's executive order that required equal employment opportunity is now understood as mandating minority hiring with numerical goals tantamount to quotas. Herman Belz's "Equality Transformed: A Quarter-Century of Affirmative Action "traces this transformation of equality and how it was brought about by courts, regulatory agencies, and activists. The early champions of civil rights sought to eradicate impediments to advancement for the downtrodden; the ultimate aim was to create a truly colorblind society. Over the years, this goal, while still professed, became even more elusive. It suggests un fairness, prejudice and favouritism. It seems to point to adeparture from the ideal of equal opportunities, equal rewards and even-handed legal protection of all human beings without regard to differences of race, religion, ethnic origin or sex. Similarly, in public international law "discrimination" suggests violation of the principle of equality of states. Yet there are vast areas of international relations in whieh states are regarded as being legally free, except as specially provided in treaties, to make distinctions between other states or their nationals. The principle of equality of states merely means that the many rules constituting what is often called "general (or universal) international law" apply equally to all independent states. Hence, by definition, such states have equal rights and duties under general international law. But the latter leaves vast areas of transnational activity to be regulated by states at their discretion either unilaterally or by special agreement with other states. No state has, in fact, exactly the same totality of rights and duties as other states, since no two states are parties to exactly the same treaties. By treaty, astate often grants to another state a right which it may withhold from third states.

These seem to be the standard views, but this book argues that they are all flawed. We also need to rethink our approach to the related issue of discrimination. We tend to assume discrimination is wrong because it violates either meritocracy or equality, when in fact it is wrong for quite different reasons. In all these areas, then, Cavanagh aims to loosen the grip of established ways of thinking, in order that other ideas might find room to breathe. This is particularly important in the case of meritocracy, which after the recent conversion of the centre-left now dominates the debate more than ever. This book will be of interest to students and teachers of political philosophy, but ultimately it is aimed at anyone who cares about the fundamental values that lie behind the way society is organized. Before WWII, it focused on enhancing conditions for male industrial workers in Western, often imperial, economies, while restricting the circumstances of women's labors. Over time, the ILO embraced non-discrimination and equal treatment. It now promotes fair globalization, standardized employment and decent work for women in the developing world. In Making the Woman Worker, Eileen Boris illuminates the ILO's transformation in the context of the long fight for social justice. Boris analyzes three ways in which the ILO has classified the division of labor: between women and men from 1919 to 1958; between women in the global south and the west from 1955 to 1996; and between the earning and care needs of all workers from 1990s to today. Before 1945, the ILO focused on distinguishing feminized labor from male workers, whom the organization prioritized. But when the world needed more women workers, the ILO (a UN agency after WWII) highlighted the global differences in women's work, began to combat sexism in the workplace, and declared care work essential to women's labor participation. Today, the ILO enters its second century with a mission to protect the interests of all workers in the face of increasingly globalized supply chains, the digitization of homework, and cross-border labor trafficking. As Boris shows, the ILO's treatment of women is a window into the modern history of labor. The historic relegation of feminized labor to the part-time, short-term, and low-waged prefigures the future organization of work. The labor force is increasingly self-employed and working as long as possible--a steep price for flexibility--with minimal governmental oversight. How we treat workers in the next century will inevitably build upon evolving ideas of the woman worker, shaped significantly through the ILO.
