Book Synopsis The Codex of the Endangered Species Act by : Lowell E. Baier
Download or read book The Codex of the Endangered Species Act written by Lowell E. Baier and published by Rowman & Littlefield. This book was released on 2023-07-25 with total page 865 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Endangered Species Act of 1973 (ESA) is one of the most cherished and reviled laws ever passed. It mandates protection and preservation of all the nation’s species and biodiversity, whatever the cost. It has been a lightning rod for controversy and conflicts between industry/business and environmentalists. The year 2023 marks the 50th anniversary of this law, and provides an opportunity for a measured and thorough evaluation thereof. We cannot know today’s challenges and opportunities without understanding their histories. This book is the most comprehensive history of the ESA ever published, and the first to consider the entire history of the law from all angles in a single volume. The history of the ESA has been one of increasing impact, complexity, and controversy. In 1978, the Supreme Court declared that Congress intended for the U.S. government to save all species at any cost, and thereafter application of the ESA became steadily more controversial, as seen in the example of the northern spotted owl and the timber wars in the Pacific Northwest in the late 1980s and early 90s, and then everywhere as the ESA became a political football in the highly partisan environment of the late 1990s and amendments to the law ceased. This book is not only a history, but a call to action. It will take more conservation, more funding, and more innovative solutions if we are to save our wildlife and biodiversity. It will take the engagement to every American to muster the collective will to meet this challenge. The hope of this book is that we will be able to look back and say that we accomplished more in the second 50 years of the ESA than we did in the first.
Book Synopsis Science and the Endangered Species Act by : National Research Council
Download or read book Science and the Endangered Species Act written by National Research Council and published by National Academies Press. This book was released on 1995-10-13 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Endangered Species Act (ESA) is a far-reaching law that has sparked intense controversies over the use of public lands, the rights of property owners, and economic versus environmental benefits. In this volume a distinguished committee focuses on the science underlying the ESA and offers recommendations for making the act more effective. The committee provides an overview of what scientists know about extinctionâ€"and what this understanding means to implementation of the ESA. Habitatâ€"its destruction, conservation, and fundamental importance to the ESAâ€"is explored in detail. The book analyzes: Concepts of speciesâ€"how the term "species" arose and how it has been interpreted for purposes of the ESA. Conflicts between species when individual species are identified for protection, including several case studies. Assessment of extinction risk and decisions under the ESAâ€"how these decisions can be made more effectively. The book concludes with a look beyond the Endangered Species Act and suggests additional means of biological conservation and ways to reduce conflicts. It will be useful to policymakers, regulators, scientists, natural-resource managers, industry and environmental organizations, and those interested in biological conservation.

Available in PDF, EPUB and Kindle. Book excerpt: Next Generation INDIE Book Awards Grand Prize Winner, Best Non-Fiction Book in 2017; and Winner in the Science/Nature/Environment category Finalist for Foreword INDIES Book of the Year Awards in Ecology and Environment In this book, Lowell E. Baier, one of America’s preeminent experts on environmental litigation, chronicles the century-long story of Americas’ resources management, focusing on litigations, citizen suit provisions, and attorneys’ fees. He provides the first book-length comprehensive examination of the little-known Equal Access to Justice Act (EAJA) and its role in environmental litigation. Originally intended to support veterans, the disabled and small business, EAJA, Baier argues, now paralyzes America’s public land management agencies. Baier introduces readers to the history of EAJA, examines the many beneficiaries of the law, describes in depth 20 of the most prominent litigious environmental groups in America, and recommends carefully tailored amendments to the EAJA to correct environmental abuses of the law while protecting legitimate interests. Inside the Equal Access to Justice Act will be a valuable resource for the environmental legal community, environmentalists, practitioners at all levels of government, and all readers interested in environmental policy and the rise of the administrative state.

Book Synopsis The Expendable Future by : Richard J. Tobin
Download or read book The Expendable Future written by Richard J. Tobin and published by Duke University Press. This book was released on 1990 with total page 340 pages. Available in PDF, EPUB and Kindle. Book excerpt: Species are disappearing from the earth at a rate of hundreds, and perhaps thousands, of times greater than every before witnessed. According to many scientists, this rapid destruction will lead to irreversible changes in the earth's ecosystem. The Expendable Future provides a comprehensive and critical evaluation of the politics of biological diversity in the United States and of state and federal policies on endangered species from the early 1960s to the present. Drawing on congressional hearing and debates, previously unpublished public opinion surveys, interviews with state officials and employees of the Department of the Interior, and internal documents from this and other government agencies, Tobin provides an in-depth analysis of the policies on endangered species and the policy relationships among the different units of government involved in implementation. He examines the resources that are available for the protection of endangered species and the way in which those resources are matched to the priorities. Tobin also discusses the processes by which species are classified as endangered, how these species' critical habitats are determined and protected, and the successes, and mostly failures, of current recovery programs.
