Updated as of May 29, 2018 We, the National Marine Fisheries Service (NMFS), designate and authorize the release of a nonessential experimental population of Upper Columbia River (UCR) spring-run Chinook salmon (Oncorhynchus tshawytscha) under section 10(j) of the Endangered Species Act (ESA) in the Okanogan River subbasin, and establish a limited set of take prohibitions for the nonessential experimental population under section 4(d) of the ESA. Successful reintroduction of a population within the species' historic range would contribute to its viability and further its conservation. The issuance of limited protective regulations will provide for the conservation of the species while providing assurances to people in the Okanogan River subbasin. The geographic boundary for the NEP is the main stem and all tributaries of the Okanogan River between the Canada-United States border and to the confluence of the Okanogan River with the Columbia River, Washington (hereafter "Okanogan River NEP Area"). We have prepared a Final Environmental Assessment (EA) and Finding of No Significant Impact (FONSI) on the proposed action under the National Environmental Policy Act (NEPA) (see ADDRESSES: section below). The geographic boundaries of the NEP extend upstream from Round Butte Dam on the Deschutes River (about river mile (RM) 110, river kilometer (rkm) 177) and all accessible reaches of the Deschutes River and its tributary Whychus Creek; on the Crooked River from its confluence with the Deschutes River upstream to Bowman Dam (RM 70, rkm 113) and all accessible tributaries between these points; and on the Metolius River from its confluence with the Deschutes River upstream to all accessible tributaries between these points. This NEP designation will have an expiration date 12 years from the effective date of this final rule. We anticipate providing a notice in the Federal Register about 1 year before the NEP designation is set to expire to provide adequate notice to the public. Book excerpt: "In response to a petition to list under the U.S. Endangered Species Act both spring-run and fall-run Chinook salmon in the Upper Klamath and Trinity Rivers (UKTR) Chinook Salmon Evolutionarily Significant Unit (ESU) the National Marine Fisheries Service (NMFS) Southwest Fisheries Science Center convened a Biological Review Team (BRT) to evaluate new information they determined to be most relevant to the questions of ESU configuration and status. This included information provided by the Petitioners in their petition, information deemed pertinent by the BRT, and information provided to the NMFS Southwest Regional Office by other parties interested in this issue. The purpose of this Technical Memorandum is to document the BRT's review and analysis of this information and to report their findings. Mo st importantly, the BRT concluded that the new information supported the existing UKT R Chinook ESU configuration with spring- run and fall-run populations included in a single ESU, and that the ESU is currently at a low risk of extinction within the next 100 years"--Executive summary.
