Book excerpt: When the US Immigration and Naturalization Service (INS) was disbanded in 2003 many of its components were absorbed into the new Department of Homeland Security (DHS). One of these new entities, called US Citizenship and Immigration (USCIS), now has the formidable task of processing and keeping track of all the applicants for entry into the United States. Its goal is to serve the immigrant community effectively, efficiently, and fairly, while avoiding the problems and deserved criticisms of its predecessor organization. USCIS is expected to achieve this goal under the administrative authority of DHS that has goals that may not be compatible. The primary mission of DHS is to fight terrorism, and providing good service to clients may be incidental. In this reorganization many members of the immigrant community fear they are viewed as potential terrorists. That it also has responsibility for refugee applicants raises the issue of the blurring of immigration and asylum - the former is about control whereas the latter should be focused on protection. The possible effects of these organizational changes on immigrants, refugees, and the nation are reviewed in this paper.

Book excerpt: At current migration rates, about two-thirds of U.S. population growth in the next fifty years will be attributable to immigrants, their children, and their grandchildren. Despite the issue's importance, the Immigration and Naturalization Service has relatively low stature, and no formal structure exists within the Executive Branch for coherent immigration policy development. This is especially problematic because the immigration function cuts across numerous critical policy issues ranging from social security, welfare, and human resources to education, economic competitiveness, law enforcement, and foreign policy. Frustration with INS performance has been mounting for a decade, as have charges that the system is incoherent, overburdened, poorly run, and accountable to no one. Some in Congress now propose dismantling the agency and distributing its functions to other agencies. The authors of this book argue that, among the several reform proposals that have been proffered, theirs is the only effort to redesign the system in light of its fundamental objectives. Their proposal, calling for a new, high-level agency to direct and consolidate the nation's immigration system, also seeks to establish a clear distinction between enforcement and services and to improve the delivery of all programs, including the trouble-plagued services.

During a speech made while signing the Homeland Security Appropriations Act for 2006, President George W. Bush stressed that in order to defend the United States from terrorists and criminals, the borders and interior of the country must be secured and immigration laws enforced. Unique to the authority found in ICE is the responsibility to carry out this mission. ICE can only accomplish this mission as an integrated and focused agency. However, evidence exists that ICE, which was created by the merger of the Immigration and Naturalization Service and the Customs Service, has not integrated legacy work forces to produce an efficient and unified organization. The evidence suggests that a failed merger plan has left ICE with a segregated workforce that is dysfunctional in executing an enforcement strategy utilizing the blended workforce. This thesis examines and assesses the result of the merger and seeks to identify the causes of inefficiency in the current organization. The thesis recommends a course of action that will mitigate the issues present and help ICE to become an efficient and focused agency.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel.
