Book excerpt: Seminar paper from the year 2003 in the subject Business economics - Law, grade: 1.0 (A), Hawai'i Pacific University (-), course: MBA-Program (Vorlesung), language: English, abstract: Employee privacy is increasingly becoming an issue for employers, unions, employees and lawyers. Employer requirements to conduct tests and acquire additional information from employees, such as drug and alcohol use and testing has become a privacy concern. While increasingly employers have to ensure that their employees are fit for duty, the use of drug and alcohol testing is still controversial. With respect to drug and alcohol testing, some states prohibit such tests but state law varies dramatically. A study shows that America′s drug problem is big. America, with 5% of the entire world′s population buys and consumes fully 60% of the entire world′s supply of illegal drugs and 77% of all illegal drug users are employed. Ostensibly, prospective employers and employees want the same thing: to match the best person with the most fitting job. Many employers are quick to welcome outside evaluations of an individual′s mental and physical fitness and integrity, and to believe in their results - often at the risk of sacrificing individual privacy rights. The issue here is, should employers require their employees to be alcohol and drug tested and how does it affect privacy rights. In general, under human rights law, drug and alcohol testing are only allowed in certain circumstances. It is discriminatory to test potential or existing employees for drug and alcohol use if there is not a valid reason to test. The alternatives employers have are either drug test job applicants and existing employees or do not drug test them. There are pros and cons regarding alcohol and drug testing that need to be considered before deciding which alternative to chose. Criteria that is used in this research paper are basically violation of privacy rights and security and safety concerns.

Download or read book Legal Considerations in Drug Use Testing written by RT. Chamberlain and published by . This book was released on 1989 with total page 5 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although there are many legal issues associated with substance abuse testing, this presentation deals with only three areas: privacy, employee contractual concerns, and wrongful use of test results. Privacy must be considered under the federal and state constitutional guarantees to public employees, or whether one is a private employee so as not to determine applicability. In addition, there are state and federal statutes to deal with along with private civil actions such as the tortious invasion of privacy. Under contractual relationships, courts have gone a long way from allowing termination-at-will to public policy exceptions of forensic and implied covenants and guarantees of requiring just cause before discharge. Union involvement may necessitate bargaining in the implementation of substance abuse testing. The wrongful use of test results most often leads to actions of defamation.

Book Synopsis Drug Testing and Privacy by : Privacy Commissioner of Canada
Download or read book Drug Testing and Privacy written by Privacy Commissioner of Canada and published by DIANE Publishing Inc.. This book was released on 1990 with total page 188 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The growing pressures in society and government for drug testing programs and the intrusiveness of both testing procedures and their results on personal privacy led the Privacy Commissioner to undertake a review of federal government drug testing policy and practice. While there is no doubt that drug testing infringes personal privacy in a profound sense, one must not be blind to the need to protect the public interest. R.I.D.E. programs, for example, are seen as justifiable intrusions on private rights to safeguard the public good, even in light of the Charter of Rights. The recommendations contained in this report are offered as a contribution to the ongoing debate and a guide to government. The development of drug testing policies and practices which respect the requirements of the Privacy Act and which keep in appropriate balance public and private rights will be a unique anddifficult challenge"--Introduction, p.2.
