En effet, deux libertés, celle de l'expression des médias et celle du respect des droits de la personne, aussi fondamentales l'une que l'autre, sont inévitablement amenées à s'affronter. Cette situation complexe suscite de multiples interrogations. Comment organiser ou moderniser leur rapport eu égard aux développements des possibilités d'atteintes aux droits de la personne afin de rétablir un équilibre harmonieux ? Toute la difficulté a consisté pour le législateur, à déterminer au regard du principe de liberté d'expression, quelles limites pouvaient être apportées pour endiguer l'accroissement des dangers encourus par la personne. On a vu qu'au 20ème siècle les parlementaires ont choisi de contourner la loi du 29 juillet 1881 sur la presse et de faire appel au droit commun pour protéger davantage les droits individuels. Mais, la dispersion textuelle entre d'une part, droit spécial et droit commun, et d'autre part, entre droit pénal et droit civil, a été une source de difficultés supplémentaires, car elle implique incontestablement une multiplicité de régimes juridiques applicables. La question se pose par ailleurs de savoir si cela est conforme aux exigences de clarté et de prévisibilité de la loi exigées par la Cour européenne des droits de l'homme. A cet égard, l'européanisation du droit de la communication paraît propice à une réforme législative d'ensemble permettant de repenser le rapport entre ces deux libertés à la lumière des impératifs européens. En allant plus loin, la mondialisation de la communication avec internet, implique de faire appel à d'autres modes de régulation des libertés emprunts de plus de souplesse comme la déontologie et le renforcement de la coopération internationale.
