La recherche entreprise ici conduit à préconiser une implication définitive et effective de la règle d'exemption dans le contrôle des ententes. Pour parvenir à cette conclusion, la démonstration du traitement contrasté que réserve le droit de la concurrence à l'exemption individuelle est apparue comme un préalable indispensable. Le droit de la concurrence renouvelle la règle d'exemption individuelle mais, en même temps, il la relègue en lui préfèrant d'autres mécanismes aboutissant au même résultat qu'elle, à savoir la non interdiction de l'entente. Or, si ces mécanismes, procédure d'engagements, seuil de sensibilité et exemption par catégories, sauvent l'entente, tout comme la règle d'exemption individuelle, ils n'ont ni le même fonctionnement, ni les mêmes effets de cette dernière à l'égard de la sanction et de la réparation du dommage concurrentiel. Dès lors, la règle d'exemption s'affirme comme une notion irremplaçable au sein du droit des ententes. Sa reconnaissance se montre ainsi nécessaire, et ceci à travers l'examen individuel et contentieux de l'entente. Néanmoins cette reconnaissance se heurte à deux obstacles, l'un d'ordre substantiel, consistant dans l'instrumentalisation de l'exemption et l'autre de nature structurelle, résidant dans l'altération du raisonnement binaire nécessaire à l'exemption. Tenant compte de ces difficultés, découlant de la manière dont est interprété le principe d'interdiction de l'entente, la solution serait de renforcer le rôle du bilan concurrentiel, mécanisme de l'exemption, pour devenir une méthode d'appréciation de la licéité de l'entente et non seulement, comme c'est le cas aujourd'hui, un moyen de justification de l'entente anticoncurrentielle.

For the past decade, academic publications have focused on the proposal for a Directive on damages actions, then the Directive 2014/104/EU of 26 November 2014 itself, and finally the transposition texts. However, this understandable interest should not lead to overlook the fact that the Directive has been applied very little until now. This is mainly due to its application ratione temporis. In addition to the fact that Member States only transposed the Directive between the end of 2016 and 2018, Article 22 of the Directive provides that the substantive rules contained in the Directive cannot be applied to infringements subsequent to the national laws transposing them, while the procedural rules of the Directive apply to proceedings commenced on or after 26 December 2014. Thus, it is prior domestic law that continues to govern the vast majority of cases before national courts in the “Pre-Directive era.” In addition, a number of issues of the utmost importance have not been addressed by the Directive, such as questions of international jurisdiction or the quantification of “interests.” For these reasons, it seemed necessary not to limit this book to commenting on the Directive, important as it is, but to go beyond it. Directed by Rafael Amaro, this book contains the contributions from leading academics, attorneys, jurists and economists in the field of the private enforcement of competition law.
