Book excerpt: This report had endorsed draft laws to extend dangerous dogs offences to attacks on private property and on assistance dogs. But the MPs criticise the Government for failing to bring in wider measures, including Dog Control Notices, to tackle out-of-control dogs. MPs also endorse the proposed amendment to the Dangerous Dogs Act 1991 making attacks on private land the same as attacks on public land. The current law makes it impossible to bring criminal charges against an owner whose dog attacks someone in a private place, such as a home. The Committee welcomed the proposal to enable action to be taken regardless of where a dog attack happens. The Committee agree with the Government that the protection from prosecution should apply only when an attack takes place on a trespasser in the house, not in a surrounding area such as the garden or drive. However, measures taken by the owner to minimise the likelihood of their dog acting aggressively toward someone unexpectedly in such places should be taken into account by enforcement agencies and the courts. MPs fully support the measures to extend offences to those committed against an assistance dog, such as a guide dog, in the same way as if the attack were on a person. This reflects the significant consequences such attacks have on the daily lives of people who rely on assistance dogs. The Committee recommends that such offences should be extended to apply to any attack which injures a protected animal, such as a horse or livestock.

Book excerpt: The UK established the world's first animal welfare protection laws, with the passing of the Protection of Animals Act in 1911 which made it an offence to cause unnecessary suffering to any domestic or captive animal. This draft Bill, which extends to England and Wales, seeks to consolidate and modernise the legislation in line with current animal welfare standards, including the reforms undertaken in other countries such as New Zealand and Sweden. Amongst its provisions, which are grouped under 10 headings, the draft Bill seeks to: i) establish a duty of care to ensure the welfare of all kept animals, enabling animal welfare organisations to intervene where there is evidence an animal is being kept in conditions likely to lead to suffering, rather than having to wait for evidence that the animal has suffered abuse before legal action can be taken; ii) prohibit the sale of pets to children under 16; iii) end the practice of giving pets, including goldfish, as prizes, for example at funfairs; and iv) make offences of animal cruelty or keeping animals for fighting arrestable offences, with the maximum penalty leading to imprisonment upto 51 weeks or a fine of upto £20,000, or both. This publication contains the text of the draft Bill, explanatory notes and a regulatory impact assessment.

At a jurisprudential level there is an unspoken view that legislation is generally piecemeal and at best self-contained and specific; at worst dependent on the whim of political views at a particular time. With a different starting point, this volume seeks to test such notions, illustrating, among other things, the widespread and lasting influence of legislation on the shape and principles of the law of tort; the variety of forms of legislation and the complex nature of political and policy concerns that may lie behind their enactment; the sometimes unexpected consequences of statutory reform; and the integration not only of statutory rules but also of legislative policy into the operation of tort law today. The apparently sharp distinction between judicially created private law principles, and democratically enacted legislative rules and policies, is therefore questioned, and it is argued that to describe the principles of the law of tort without referring to statute is potentially highly misleading. This book shows that legislation is important not only because of the way it varies or replaces case law, but because it also deeply influences the intrinsic character of that law, providing some of its most familiar characteristics. The book provides the first extended interpretation of legislative intervention in the law of tort. Each of the chapters, by leading tort scholars, deals with an aspect of the influence of legislation on the law of tort. While the nature, sources and extent of legislative influence in personal injury law is an essential feature of the collection, other significant areas of tort law are explored, including tort in the context of commercial law, labour law, regulation and the welfare state. Essays on the Compensation Act 2006 and Human Rights Act 1998 bring the current state of the interplay between tort, politics and legislation to the forefront. In all of these contexts, contributors explore the deeper lessons that can be learned about the nature of the law of tort and its changing role and functions over time.
