Book excerpt: The damage portion of a personal injury claim is the heart of the tort case and determines whether or not the claim is worth pursuing. The attorney must be able to determine accurately the level of damages the injured plaintiff can expect to recover for his or her injuries. The checklist format of this book provides a quick and thorough reference for an attorney to use when evaluating a client's personal injury case. The attorney can ensure that he or she has met the obligation owed to the client to identify and calculate properly those damages recoverable and make sure that the damages are pleaded properly and that the evidence necessary to prove the claim is gathered. This checklist allows the attorney to determine the appropriate basis for the damage claim and what evidence and testimony will be needed.

Book excerpt: The Guidelines for the Assessment of General Damages are designed to provide a clear and logical framework for the assessment of damages in personal injury cases. The first edition of this title was regarded as a landmark in personal injury practice. Each succeeding issue has built on this reputation and the book has now firmly established itself as essential reading for all those involved in the area of personal injury litigation. This new edition has updated the award figures to take into account the rise in inflation. The book also considers a small number of decisions concerning damages for sexual abuse, including image based abuse, since the previous edition. This book is edited by a working party of the Judicial College, under the chairmanship of The Hon. Mrs Justice Lambert DBE. The members of the working party are all lawyers and personal injury specialists: Stuart McKechnie KC, barrister; Steven Snowden KC, barrister; Lisa Sullivan, Master of the Queen's Bench Division; and Richard Wilkinson, barrister.

Book excerpt: "In this book, I examine every aspect of personal injury litigation, from attracting new clients to jury trials, and beyond. The personal injury laws vary from state to state and between state and federal court. Since 1983, I have been a trial lawyer in Pennsylvania and New Jersey. Much of the information presented involves those experiences. The law in your state may be different. Nevertheless, there is much uniformity throughout the states. The information in this book can be used by personal injury litigants and their counsel in any state. You may have to refer to local sources for the law or practice that applies to your situation". -- INTRODUCTION.

Available in PDF, EPUB and Kindle. Book excerpt: The book includes multiple lists that provide helpful summaries on various aspects of an auto injury claim. The first identifies five tactics the insurance company uses to gain an advantage over a claimant including: making false promises, delaying your claim, and misrepresenting proper medical treatment and how it will be paid. A second useful list is the to-do list for documenting the scene of the crash, which includes what to photograph and what information to collect from witnesses. A third list covers the eight steps to handling a property damage claim. For someone only dealing with property damage, it is a guide for what to do. He even offers certain keys to determine when you need to hire a lawyer and how you should share information with the lawyer. The section on documenting an injury goes into what it takes to have a good case. A good case has three main parts: liability (the other person is at fault), causation (the link between liability and damages), and damages (property damage, physical injuries, loss of income, etc.). You can¿t have one without the other two. You can¿t have two without the other one. The most challenging parts are establishing causation and damages, and he includes recommendations for avoiding causation problems particularly with respect to reporting and documenting medical injuries. One unique piece of advice was his recommendation that the patient, when speaking with the doctor, avoid self-diagnosing (putting words in the doctor¿s mouth) and overloading the doctor with information extraneous to the pains and problems that stem directly from the car wreck. With a contemporary twist, the book also looks at the perils and pitfalls of our cultures¿ reliance on social media. He describes how information gleaned from Twitter and Facebook can seriously undermine a case¿especially when it falls into the hands of Mr. Insurance Defense Attorney.

This book instructs the attorney in the selection of experts, how that information is used, and the interpretation of experts' reports. Included are checklists for case preparation, legal guidelines for expert testimony, glossaries of scientific terms used by experts, sample casework, and reports.

The text sets out the substantive law governing the legal duties owed by road users, employers and members of the medical profession, and explores topics such as limitation and psychiatric illness, so that the procedural law governing personal injury and clinical negligence claims may be understood in context. In a clear and concise way, it demonstrates how such claims are conducted under the Civil Procedure Rules (CPR), from the first interview through to the quantification of damages. The appendices include pre-action protocols for personal injury claims, disease and illness claims and for the resolution of clinical disputes, in addition to extracts from the Ogden tables. There is also a personal injury case study which includes key documentation.
