Available in PDF, EPUB and Kindle. Book excerpt: International law is usually conservative, with lawyers and judges emphasizing consistency, stability and predictability as the major advantages of the law. Legal scholars often prefer not to challenge the status quo, to suggest amendments, or to reform institutions, advocating simply to focus on the implementation of the laws that already exist. This collection stands different. It shares the authors’ discomfort with the present legal order and some of its institutions and courts, and dives into either a corrective or a profound reimagination of these, so that they can better address rising global challenges. Leading experts in their areas present their new and cutting-edge perspectives. Divided into six parts, the volume paints a vast yet solid thematic landscape of unique and critical approaches. The book invites and allows for a deep engagement with a wide range of opinions from across the world. It enables a free and courageous reimagining of the international legal order, detached from the endless feasibility skepticism. The work will be fascinating reading for students, academics and researchers working in the areas of International Law and International Relations.

Book excerpt: In the 20th and 21st centuries, where violence has scarred countless lives, the interplay between religion, politics, and conflict remains a complex web. Exiting Violence looks to untangle some of these knots, showing not only how faith can ignite bloodshed, but also how it can inspire peace and build bridges. Resulting from an international collaboration between the Fondazione Bruno Kessler, RESET-Dialogues Among Civilizations, and the Berkley Center for Religion Peace and World Affairs, this collection assesses the state of scholarship and explores the differing ways in which religion can contribute to societies and communities exiting situations of violence and hatred. From Biblical hermeneutics to Buddhism, from secularism to legal systems, Exiting Violence offers a nuanced and thought-provoking exploration of the multifaceted role religion plays in the human struggle for peace and justice.

Available in PDF, EPUB and Kindle. Book excerpt: Intergovernmental Relations in the UK provides a timely and up-to-date analysis of a turbulent decade in British politics and presents a fascinating case study of intergovernmental relations and territorial power in a devolved unitary state. As over time a widening range of powers has been transferred from the Westminster Parliament to the devolved legislatures in Scotland, Wales and Northern Ireland, intergovernmental relations have become increasingly important to deal with the corresponding overlaps of legislative and fiscal authority. However, leaving the European Union has exposed the weakness of the intergovernmental architecture and challenged the functionality of the UK’s multilevel polity. Until now, the question of how powerful the devolved administrations really are has not been satisfactorily answered. The author uses insights from comparative studies of federations to develop a systematic account of shared rule and intergovernmental relations. This book examines how informal institutions and practices can provide political influence beyond formal structures, with reference to an extensive range of institutions, practices, policies and political decisions. Unlike other studies focused predominantly on the state of the Union, this volume points to the interplay between conflict and cooperation, and demonstrates that the proclaimed ‘break-up of the Union’ is accompanied by efforts to integrate the different jurisdictions. This book will be of interest to scholars and postgraduate students of comparative politics, political systems, multilevel governance, regional and federal studies, British politics and public administration. It will also appeal to politicians, government advisers, civil servants and other practitioners who seek a better, more nuanced understanding of the UK’s multilevel constitution and politics, and the nature of intergovernmental relations in the UK.

Available in PDF, EPUB and Kindle. Book excerpt: A tension lies at the heart of family law. Expressed in the language of rights and duties, it seeks to impose enforceable obligations on individuals linked to each other by ties that are usually regarded as based on love or blood. Taking a contextual approach that draws on history, sociology and social policy as well as law and legal theory, this book examines the concept of obligation as it has been developed in family law and the difficulties the law has had in translating it from a theoretical and ideological concept into the basis of enforceable actions and duties. Increasingly, the idea of commitment has been offered as the key organising principle for the recognition of family relationships, often as a means of rebutting claims that family ties are becoming attenuated, but the meaning and scope of this concept have not been explored. The book traces how the notion of commitment is understood and how far it has come to be used as a rationale for imposing the core legal obligations which underpin care and caring within families.

Available in PDF, EPUB and Kindle. Book excerpt: There is a tension at the heart of family law and policy between the increasing influence of individual autonomy and the demands of caring for children. Individual autonomy envisages decisions made in one's own best interests, whereas decisions around care are often made for the good of the family, and may conflict with the caregiver's individual interests. Whereas individual autonomy valorises economic self-sufficiency, caregiving responsibilities constrain choice and conflict with paid work. This book explores this tension to consider how, given changing social trends, family law and policy should take account of caregiving responsibilities on parental separation. Crucially, it suggests that we need to rethink family law by placing care at its centre. This book draws on original empirical data to explore the experiences of parents in England and Wales, where the division of paid work and care is considered a choice, and Sweden, where parents are encouraged to work full-time, supported by wellfunded state childcare. This comparative perspective sheds light on whether the clash between the ideas of autonomy and care could be reconciled in a more gender equal society. The book argues that caregiving is hidden from, and undervalued by, law and policy in both jurisdictions, underscoring the need for the proposed new approach. The law needs to think more deeply about what it means to care, and how the care provided by parents differs. Anna Heenan outlines how family law might look different if the proposed framework, based on placing care at the heart of family law, is adopted.
