Book excerpt: Traditional accounts of the Scottish Enlightenment present the half-century or so before 1750 as, at best, a not-yet fully realised precursor to the era of Hume and Smith, at worst, a period of superstition and religious bigotry. This is the first book-length study to systematically challenge that notion. Instead, it argues that the era between approximately 1680 and 1745 was a 'First' Scottish Enlightenment, part of the continent-wide phenomenon of early Enlightenment and led by the Jacobites, Episcopalians, and Catholics of north-eastern Scotland. It makes this argument through an intensive study of the dramatic changes in historiographical practice which took place in Scotland during this era, showing how the documentary scholarship of Jean Mabillon and the Maurists was eagerly received and rapidly developed in Scottish historical circles, resulting in the wholesale demolition of the older, Humanist myths of Scottish origins and their replacement with the foundations of our modern understanding of early Scottish history. This volume accordingly challenges many of the truisms surrounding seventeenth- and eighteenth-century Scottish history, pushing back against notions of pre-Enlightenment Scotland as backward, insular, and intellectually impoverished and mapping a richly polymathic, erudite, and transnational web of scholars, readers, and polemicists. It highlights the enduring cultural links with France and argues for the central importance of Scotland's two principal religious minorities--Episcopalians and Catholics--in the growth of Enlightenment thinking. As such, it makes a major intervention in the intellectual and cultural histories of Scotland, early modern Europe, and the Enlightenment itself.

Book excerpt: Migrating Words, Migrating Merchants, Migrating Law examines the connections that existed between merchants’ journeys, the languages they used and the development of commercial law in the context of late medieval and early modern trade. The book, edited by Stefania Gialdroni, Albrecht Cordes, Serge Dauchy, Dave De ruysscher and Heikki Pihlajamäki, takes advantage of the expertise of leading scholars in different fields of study, in particular historians, legal historians and linguists. Thanks to this transdisciplinary approach, the book offers a fresh point of view on the history of commercial law in different cultural and geographical contexts, including medieval Cairo, Pisa, Novgorod, Lübeck, early modern England, Venice, Bruges, nineteenth century Brazil and many other trading centers. Contributors are Cornelia Aust, Guido Cifoletti, Mark R. Cohen, Albrecht Cordes, Maria Fusaro, Stefania Gialdroni, Mark Häberlein, Uwe Israel, Bart Lambert, David von Mayenburg, Hanna Sonkajärvi, and Catherine Squires.

This classic can be ranked among the well-known international standard works on the subject of bookbinding. The author, Dr. Jan Storm van Leeuwen, gives in this work an elaborate general historical introduction to his subject. It also contains a general introduction to each province, as they were known in the eigteenth century, and an extensive overall picture of the towns where luxury bindings were manufactured, describing the bookbinder's workshops and binderies of each town. The historical introduction is completed with a catalogue of the approximately 2000 relevant bindings in the collections of the Koninklijke Bibliotheek (National Library of the Netherlands) and its sister institution the Museum Meermanno-Westreenianum. About 1500 other bindings that the author studied over time in other collections are also described. But the most important feature of this work is that all (nearly 10.000) stamps on these bindings are represented by a picture. Never before so many bindings (3500) have been recorded, described and discussed in such detail and with the benefit of an established model and terminology. The print edition is available as a set of four volumes (9789061943693).

Book excerpt: This book is widely regarded as one of the most remarkable achievements in Roman Law and Comparative Law scholarship this century - a fact attested to by the universal acclaim with which it has been received throughout Europe, America, and beyond. As a work of Roman Law scholarship it fusesthe vast volume of 20th century scholarship on the Roman law of obligations into a clear and very readable (and in many ways original) account of the law. As a work of comparative law it traces the transformation of the Roman law of obligations over the centuries into what is now modern German,English and South African law, presenting the reader with a contrast between these legal systems which is unique both in its scope and its depth. As a whole the book is written with a deep understanding of human nature and of many social, economic, and other forces that determine the face of thelaw.

Book excerpt: A collaboration of leading historians of European law and philosophers of law and politics identifying and explaining the practice of interpretation of law in the 18th century. The goal: establishing the actual practice in the Age of Enlightenment, and explaining why this was the case. The ideology of the Age was that law, i.e., the will of the sovereign, can be explicitly and appropriately stated, thus making interpretation redundant. However, the reality was that in the 18th century, there was no one leading source of national law that would be the object of interpretation. Instead, there was a plurality of sources of law: the Roman Law, local customary law, and the royal ordinance. However, in deciding a case in a court of law, the law must speak with one voice. Hence, interpretation to unify the norms was inevitable. What was the process? What role did justification in terms of reason, the hallmark of the Enlightenment, play? These are some of the questions addressed.

Book excerpt: In the Holy Roman Empire 'no prince... can forbid men passage in the common road', wrote the English jurist John Selden. In practice, moving through one the most fractured landscapes in human history was rarely as straightforward as suggested by Selden's account of the German 'liberty of passage'. Across the Old Reich, mobile populations-from emperors to peasants-defied attempts to channel their mobility with actions ranging from mockery to bloodshed. In this study, Luca Scholz charts this contentious ordering of movement through the lens of safe conduct, an institution that was common throughout the early modern world but became a key framework for negotiating freedom of movement and its restriction in the Empire. Borders and Freedom of Movement in the Holy Roman Empire draws on sources discovered in twenty archives, from newly unearthed drawings to first-hand accounts by peasants, princes, and prisoners. Scholz's maps shift the focus from the border to the thoroughfare to show that controls of moving goods and people were rarely concentrated at borders before the mid-eighteenth century. Uncovering a forgotten chapter in the history of free movement, the author presents a new look at the unstable relationship of political authority and human mobility in the heartlands of old-regime Europe.
