Book excerpt: Many people in Europe are stigmatised because of their sexual orientation or gender identity and cannot fully enjoy their universal human rights. Some of them are victims of violence, others have fled to Europe from countries where they risk being persecuted. Organisations representing lesbian, gay, bisexual and transgender (LGBT) persons have been denied registration or banned from organising peaceful meetings in some states in Europe. Too few politicians have taken a firm stand against homophobic and transphobic expressions, discrimination and violence. This report presents the results of the largest socio-legal study ever carried out on discrimination on grounds of sexual orientation and gender identity in the 47 member states of the Council of Europe. Six thematic chapters give a broad overview of the human rights situation of LGBT persons and recommendations are provided for developing and implementing effective measures to address discrimination. The report is intended as a tool for dialogue with authorities and other stakeholders. It constitutes a baseline study for further action in both legislative and policy fields to ensure that all LGBT people can effectively exercise their human rights.

The Council of Europe's standards and mechanisms seek to promote and ensure respect for the human rights of every individual. These include equal rights and dignity of all human beings, including lesbian, gay, bisexual and transgender persons. The Council of Europe has adopted a number of international legal instruments and standards on combating discrimination on ground of sexual orientation and gender identity. They illustrate the underlying message of the Organisation, which is that the Council of Europe's standards of tolerance and non-discrimination apply to all European societies, and discrimination on grounds of sexual orientation or gender identity is not compatible with these standards. This publication provides an accessible and comprehensive compilation of the standards adopted by the Council of Europe. It should serve as a reference for the governments, international institutions, NGOs, media professionals and to all those who are - or should be - professionally or otherwise involved or interested in protecting and promoting the human rights of lesbian, gay, bisexual and transgender persons.

Available in PDF, EPUB and Kindle. Book excerpt: At the height of the Second World War, Switzerland decriminalised homosexuality. At the same time, France chose to introduce a law punishing homosexual relationships in certain circumstances. These two examples illustrate contradictory attitudes adopted by European states towards homosexuals during the Second World War. Going beyond the issue of the persecution of homosexuals and the central role played by Nazi Germany between 1939 and 1945, this book is the first to examine the daily lives of homosexual men and women in wartime. By bringing together European specialists on the subject, it relates a different history, one which was indeed marked by repression but also by enlistment in armies at war and resistance groups, not to mention collaboration. Chapter by chapter, it enables us to better understand why the Second World War was a turning point for gays and lesbians in Europe and why our continent is a leader in the fight against discrimination. For the Council of Europe, this book contributes to two separate programmes, the Passing on the Remembrance of the Holocaust and Prevention of Crimes against Humanity programme and the Promoting Human Rights and Equality for LGBT People programme, within the framework of Committee of Ministers Recommendation CM/Rec(2010)5 on combating discrimination on grounds of sexual orientation or gender identity programme. It also continues work towards acknowledging all of the victims of the Nazi regime. Régis Schlagdenhauffen is a lecturer at the École des hautes études en sciences sociales (EHESS), head of the gender-based social history department, member of the Laboratory of Excellence “Writing a new history of Europe” (LabEx EHNE) and co-author of the Council of Europe pedagogical factsheets for teachers entitled “Victims of Nazism. A mosaic of fates” (2015).

This book was released on 2010-01-01 with total page 156 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Convention on Human Rights guarantees equality among human beings by means of two provisions that prohibit discrimination: On the one hand, Article 14 of the Convention, ratified by all member states of the Council of Europe; and, On the other hand, The first article of Protocol No. 12, ratified by only some of the members. The content of the prohibition laid down by these two provisions is the same, The only difference is in the extent of their scope: whereas Article 14 prohibits discrimination in the "enjoyment of rights and freedoms set forth by the present Convention", The first article of Protocol No. 12 prohibits discrimination in a broader sense in the "enjoyment of all rights set forth by law". This study proposes an insight into the case law of the European Court of Human Rights on discrimination with respect both To The main principles which guide its implementation and To The specific solutions which the Court has adopted in relation to discrimination. Other questions examined include the scope of the prohibition of discrimination (to what does it apply?), The question of the content of such a prohibition (what precise obligations does it imply?), and last, The question of a judicial review (how does the Court assess compliance with it?).The "Human rights files" series is aimed at specialists in European law: lawyers, practitioners and research students. it also constitutes a useful resource For The implementation of the European Convention on Human Rights in the signatory states.

Today, the situation for lesbian, gay, bisexual, trans and queer persons in the EU is considered a human rights concern. But what can the EU really do in order to counter homophobia and genderphobia? In this report, Judit Takács examines several types of homophobia indicators and with the help of comparative quantitative data she also illustrates the markedly different levels of social acceptance of LGBTQ persons in Europe. Available in PDF, EPUB and Kindle. Book excerpt: The Employment Equality Directive requires EU Member States to prohibit sexual orientation discrimination in the field of employment. This book is the first to assess to what degree the Directive’s requirements have been met by the twenty-five Member States and by Bulgaria and Romania. The authors discuss the relevant aspects of EU law and provide a detailed analysis of the quality and conformity of national anti-discrimination legislation aimed at implementing the Employment Equality Directive. In this analysis special attention is paid to the implications of what distinguishes sexual orientation from other forbidden grounds of discrimination. Therefore the book focuses on the various private and public aspects of sexual orientation, such as preference, behaviour, partnership and ‘coming out’. It discusses direct and indirect discrimination, harassment, permissible and impermissible exceptions, sanctions, and the role of interest groups and specialised enforcement bodies. This is done against the background of international human rights law and in relation to the general legal situation with respect to lesbian and gay rights in the twenty-seven countries. The unique perspective taken by the authors and the in-depth and systematic coverage of a wide range of jurisdictions make this book useful not only to judges, legal practitioners, policy makers, academics and students in the EU, but also to readers further afield, interested in European, anti-discrimination, sexual orientation and/or employment law. Kees Waaldijk is a senior lecturer at the E.M. Meijers Institute of Legal Studies of the University of Leiden, specialising in law & homosexuality issues. Matteo Bonini-Baraldi is a researcher, working at the Faculty of Law of the University of Bologna. Together they headed the European Group of Experts on Combating Sexual Orientation Discrimination set up by the European Commission.
