Book excerpt: This is the text of a thesis submitted (and subsequently passed) for the degree of Master of Studies in Legal Research (MSt) at the University of Oxford, Faculty of Law, in October 2004.The primary purpose of the thesis is to analyse the longstanding treatment of trade mark dilution in the United States with a view to comparing it to equivalent dilution protection available in the Law of Industrial Property of Mexico. Despite a literal reading of the Mexican statute, it is argued that dilution protection is not read at face value and is simply treated as another form of confusion protection for well-known trade marks.Beginning with an understanding of the subject matter and its underlying principles, some arguments for its justification are examined. Relevant cases interpreting the federal anti-dilution statute in the US and the principles that have emerged from such interpretations are exposed. These valuable principles are used as a benchmark by which some parallels are drawn with the Trade Mark and Courts decisions interpreting the Mexican statute. Further, the analysis suggests that both the US and Mexico face difficulties in applying their respective statutes. However, the main focus remains in Mexico and its inconsistencies in determining relevant criteria related to trade mark dilution such renown, consumer recognition, similarity, and evidence to prove it. Finally, it is suggested that urgent legislative guidance is needed to address the failure to read the Mexican statute at face value.

Dilution doctrine is condemned regularly for interfering with the rights of traders to access shared marketing language and with consumer opportunities to 'resist, subvert, and recode' brands and use them in personal and collective expression. Commentators have been so fiercely critical of anti-dilution law for its interference with competition and expression that it has become 'perhaps the most vilified doctrine within contemporary trade mark law.' Since vocal support of the doctrine has come almost exclusively from corporations that own famous marks and their representatives on the basis of the need to provide strong protection for brand investment, the debate has manifested as a dichotomy between the interests of major rights owners and those of everybody else. In more recent times, however, some scholars have suggested a more nuanced view of anti-dilution law, considering the ways in which the interests of consumers, and not just trade mark owners, might be served by this type of trade mark protection. Although this re-conceptualisation of anti-dilution law has not yet reached the mainstream, several considered arguments have been made in its favour that are worthy of discussion and evaluation. This article sets out the background against which the consumer-based justifications of anti-dilution law have emerged, and analyses each of the main consumer interest arguments that have been made in favour of the doctrine. The article concludes that, although there is merit in reconsidering the traditionally polarised nature of the dilution debate, the consumer-based justifications of anti-dilution law that have been put forward to date lack internal consistency and practical application.

Traditionally, trademarks protected the public from likelihood of confusion, assisted in consumer decisions and reduced search costs. The need to award a special scope of protection to famous trademarks from use on non-competing goods was first discussed in Kodak in 1898, holding that the use of the word Kodak for a bicycle company does not mislead consumers but takes unfair advantage of reputation. However, the most significant point in the evolution of dilution, in its early stages, was the case of Odol decided in 1924, which was the first to acknowledge the need to protect the advertising power of trademarks from being diluted, even in the absence of a likelihood of confusion. This book will provide that dilution is a ‘sui generis’ brand remedy applicable to reputed trademarks in accordance to their aggregated inherent and acquired strength. The book will address the non-harmonised nature of dilution, which reflects a problem in an age of borderless trade and cyber commerce and emphasises the need to answer the question: To what extent should reputed trademarks be protected by dilution beyond the traditional trademark protection from likelihood of confusion?
