Die Folge und das vorlaufige Ergebnis der Debatten uber eine Verfassung fur Europa war das Abkommen uber den Vertrag von Lissabon, das am 19. Oktober 2007 zwischen den Mitgliedstaaten der EU geschlossen wurde. Inhaltlich war die Ahnlichkeit zum Verfassungsvertrag kaum zu ubersehen . Die Ablehnung dieses Reformvertrags durch das Referendum in Irland am 12. Juni 2008 heizte die Debatte um die demokratische Legitimation der in der Europaischen Union getroffenen Entscheidungen jedoch von neuem an. Dabei wird vor allem ein institutionelles Demokratiedefizit betont, wonach die Burger zwar direkt betroffen von den Entscheidungen der Union seien, ihr Mitspracherecht in der Union diesem Umstand gemass jedoch keineswegs als angemessen erscheint. In welcher Form Entscheidungen der Europaischen Union ihre Rechtmassigkeit besitzen und welche Mangel ihre demokratische Ausgestaltung demnach aufweist wird im Folgenden zu uberprufen sei

Die europäischen Politiker verordneten sich eine "Denkpause" um über das weitere Vorgehen zu beraten. Schon im Sommer 2007 begann dann die Arbeit an einem neuen EU-Vertrag, welcher die gescheiterte Verfassung ersetzen sollte. Am 13. Dezember 2007 unterzeichneten die europäischen Staats- und Regierungschefs den "Vertrag von Lissabon zur Änderung des Vertrags über die Europäische Union und des Vertrags zur Gründung der Europäischen Gemeinschaft" (im Folgenden: Reformvertrag). Dieser enthält viele Elemente der alten Verfassung und soll auch einen der Hauptkritikpunkte an der Europäischen Union ansprechen: den des vermeintlichen Demokratiedefizits der Union. Kritiker werfen der EU vor, dass sie von den europäischen Bürgern nicht demokratisch zur Verantwortung gezogen werden könne. Der EU und ihren Institutionen in Brüssel, Luxemburg und Straßburg mangele es an Gewaltenteilung, Transparenz und demokratischer Kontrolle durch die europäischen Bürger. Vor allem das europäische Parlament und die nationalen Parlamente hätten zu wenig Einfluss auf die Arbeit der Kommission und des Ministerrats. Die Legitimationsketten, welche von den nationalen Bürgern über die von ihnen gewählten Regierungen in die EU hineinreichen, seien zu lang um eine effektive demokratische Kontrolle der EU zu gewährleisten. Moreover, the elections were expected to raise public interest, engagement and support for the European project. Did these elections help to increase legitimacy and accountability? Did they increase interest in and support for the 'European project'? Or, did these elections have unintended (and perhaps undesirable) consequences? This volume focuses on the consequences of European elections for public debate and involvement, for party systems, and for public opinion. EP elections have caused a number of intended consequences: the salience of the elections in the media has gone up and over time electoral competition becomes more important, engaging in the campaign can help improve EU evaluations, and Europe as a topic has become more important for voting at EP elections, boosting the prevalence of so-called EU voting. A number of intended consequences have not materialized during the life of the EP so far: knowledge or turnout levels have not gone up and citizens have not become better at judging what political parties are offering. The EP elections have, however, also yielded a number of unintended consequences: EP elections dampen turnout for first time voters in subsequent elections, EP elections cause temporary decline in EU support, and the elections have become a strategic arena for political parties to position themselves on EU issues and for new movements and parties to boost or sustain their success.
