Available in PDF, EPUB and Kindle. Book excerpt: This book studies a range of legal systems and compares them on their ability to deal with psychosocial risks at work. The book looks at prevention of psychosocial risks from a labor law perspective and at compensation and reparation from a social security law perspective. It pays special attention to the topic of bullying in the work place, which is currently the subject of most legal summons. This book presents the views on the subject from leading national and international experts and provides an in-depth coverage of legal systems used in Southern and Northern European countries, as well as Canada and Japan to deal with this topic. The topic of psychosocial risks at work has received much attention recently, both from the general public, the press, and those working in the legal arena. It is difficult for lawyers to deal with the issue of psychosocial risks at work due to the multifactorial and subjective features involved.

Available in PDF, EPUB and Kindle. Book excerpt: Unfree labor has not disappeared from advanced capitalist economies. In this sense the debates among and between Marxist and orthodox economic historians about the incompatibility of capitalism and unfree labor are moot: the International Labour Organisation has identified forced, coerced, and unfree labor as a contemporary issue of global concern. Previously hidden forms of unfree labor have emerged in parallel with several other well-documented trends affecting labor conditions, rights, and modes of regulation. These evolving types of unfree labor include the increasing normalization of contingent work (and, by extension, the undermining of the standard contract of employment), and an increase in labor intermediation. The normative, political, and numerical rise of temporary employment agencies in many countries in the last three decades is indicative of these trends. It is in the context of this rapidly changing landscape that this book consolidates and expands on research designed to understand new institutions for work in the global era. This edited collection provides a theoretical and empirical exploration of the links between unfree labor, intermediation, and modes of regulation, with particular focus on the evolving institutional forms and political-economic contexts that have been implicated in, and shaped by, the ascendency of temp agencies. What is distinctive about this collection is this bi-focal lens: it makes a substantial theoretical contribution by linking disparate literatures on, and debates about, the co-evolution of contingent work and unfree labor, new forms of labor intermediation, and different regulatory approaches; but it further lays the foundation for this theory in a series of empirically rich and geographically diverse case studies. This integrative approach is grounded in a cross-national comparative framework, using this approach as the basis for assessing how, and to what extent, temporary agency work can be considered unfree wage labor

Book excerpt: Bringing together a multidisciplinary group of experts from the fields of labour studies, public health, ergonomics, epidemiology, sociology and law, Sick and Tired examines the inequalities in workplace health and safety. Using an anti-oppressive framework, chapters interrogate a wide range of issues, including links between precarious employment and mental health, the inverse relationship between power and occupational health through the experiences of women, immigrants and older workers, and the need for creative strategies that promote health and safety in ways that support empowerment and equity.

Available in PDF, EPUB and Kindle. Book excerpt: How do governments govern today and how well do they do it? How do governments choose the tools or instruments they will use to get things done? In today's world, how could these decisions be improved from the standpoint of efficiency, effectiveness, legitimacy and accountability? "Designing Government" brings together leading experts to examine the "instrument choice" perspective on government and public policy over the past two decades. The authors examine such issues as accountability, effectiveness, sustainability, legitimacy, and the impact of globalization. The debate is enriched by contributors from several countries who provide a comparative context and, most importantly, help chart a course for the future. Moving beyond the traditional regulatory sphere and its preoccupations with deregulation and efficiency, the authors trace the complex relationships between instrument choices and governance. "Designing Government" encourages the reader to consider factors in the design of complex mixes, such as issues of redundancy, context, the rule of law and accountability. These latter factors are especially central in today's world to the design and implementation of effective instrument choices by governments and, ultimately, to good governance. The authors conclude, in fact, that seeing instrument choice itself as part and parcel of designing government and achieving good governance is both the promise and the challenge for instrument-based perspectives in the years ahead. Contributors include Hans Bressers (University of Twente), Neil Gunningham (Australian National University), John Hoornbeck (University of Pittsburgh), Margaret Hill (Infrastructure Canada), Michael Howlett (Simon Fraser University), Bridget Hutter (London School of Economics and Political Science), Pierre Issalys (Université Laval), Réjean Landry (Laval University), Roderick A. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses the developing field of Work Disability Prevention. Work disability does not only involve occupational disorders originating from the work or at the workplace, but addresses work absenteeism originating from any disorder or accident. This topic has become of primary importance due to the huge compensation costs and health issues involved. For employers it is a unique burden and in many countries compensation is not even linked to the cause of the disorder. In the past twenty years, studies have accumulated which emphasize the social causes of work disability. Governments and NGOs such as the World Bank, the International Labor Organization, and the Organization for Economic Cooperation and Development have produced alarming reports on the extent of this problem for developed and developing countries. However, no comprehensive book is presently available to help them address this emerging field where new knowledge should induce new ways of management.

Book excerpt: The transnational gathering and use of criminal evidence is a complex and sensitive matter that affects basic principles inherent in national criminal justice systems. Replacing the mutual assistance regime (letters rogatory) by a mutual recognition regime intends to facilitate the admissibility of evidence obtained from the territory of another Member State. How much harmonization of criminal procedure is needed to guarantee the free movement of criminal evidence in the EU? Do we have to develop common procedural safeguards in the EU, or can we build in human rights clauses or procedural public order clauses by which respect for fundamental rights can be a ground for the non-recognition, non-execution or postponement of the order from the issuing state? John Vervaele is Professor in Economic and Financial Criminal Law at the University of Utrecht and Professor in European Criminal Law at the College of Europe of Bruges. The main topics in his research field are: enforcement of Union law; standards of due law, procedural safeguards and human rights; criminal law and procedure an regional integration; comparative economic and financial criminal law. He has realized a lot of research in these areas, both for Dutch Departments and European Institutions and also worked as a consultant for them.
