Cette notion, appliquée en réaction aux atrocités commises par les nazis, a connu ensuite une éclipse dans sa pratique pénale en droit international. Certes, à partir de 1966 l'apartheid a été à plusieurs reprises qualifié par les organes de l'ONU de crime contre l'humanité. Toutefois, aucune procédure pénale n'a été intentée. Il faut donc admettre que de Nuremberg jusqu'à la résolution 827 adoptée le 25 mai 1993 par le Conseil de sécurité de l'ONU qui porte création d'un tribunal pour réprimer les crimes commis dans l'ex-Yougoslavie, la notion de crime contre l'humanité n'a pas été appliquée pénalement en droit international. La résolution 955 du Conseil de sécurité du 8 novembre 1994 instaure un second tribunal compétent pour les crimes commis au Rwanda en 1994 et confirme le retour de l'application pénale de la notion de crime contre l'humanité en droit international. Cependant ces deux tribunaux précités ne possèdent qu'une compétence ad hoc. Aujourd'hui avec l'instauration de la Cour pénale internationale, il faut espérer que la répression se généralise à tous les crimes commis. Les problèmes qui se posent aux juridictions internationales sont alors multiples. Il s'agit d'appliquer une norme dont la définition, à l'exception du génocide, n'a fait l'objet d'aucune convention internationale. En outre l'application de la notion de crime contre l'humanité est intimement liée au maintien de la paix ce qui n'est pas toujours compatible avec l'impératif de justice.

As Africans and their supporters mark the 200th anniversary of the abolition of the slave trade in the United States and Great Britain, the question becomes increasingly salient. Calls for reparations for the evils of slavery, as well as for past colonial and current economic and political abuses, can be heard across Africa and the African diaspora. Human rights scholar Rhoda E. Howard-Hassmann examines these calls for redress in Reparations to Africa. Her study analyzes the reparations movement from the perspectives of law, philosophy, political science, and sociology. While acknowledging the brutal background of the slave trade and colonialism, and the mistreatment of the peoples of Africa, Howard-Hassmann finds that the complexity of this history, along with facts of the contemporary situation, weakens the case for financial compensation, although she does recommend acknowledgment of, and apologies for, some actions.
