Book excerpt: María José Falcón y Tella invites us on a fascinating journey through the world of law and literature, travelling through the different eras and exploring eternal and as such current issues such as justice, power, resistance, vengeance, rights, and duties. This is an unending conversation, which brings us back to Sophocles and Dickens, Cervantes and Kafka, Dostoyevsky and Melville, among many others. There are many ways to approach the concept of “Law and Literature”. In the classical manner, the author distinguishes three paths: the Law of Literature, involving a technical approach to the literary theme; Law as Literature, a hermeneutical and rhetorical approach to examining legal texts; and finally, Law in Literature, which is undoubtedly the most fertile and documented perspective (the fundamental part of the work focusses on this direction). This timely volume offers an introduction to this enormous field of study, which was born in the United States over a century ago and is currently taking root in the European continent.

Book excerpt: This work analyses in a historical and comparative perspective the relationship between the family and the welfare state in two Mediterranean countries: Italy and Spain. Two aims form the focus of the book. Firstly, to open the black box of the family in welfare state analysis, introducing a focus on inter-generational and kin relations. Secondly, to explain why the southern welfare states have offered very low support to families with children by taking into account several factors: the legacy of fascism, the role of the Church, and the specific role played by leftist parties in defining family policy as labour policy.

This book accounts for and analyses the latest developments in Latin American presidential democracies, with a special focus on political institutions. The stellar line-up of renowned scholars of Latin American politics and institutions from Latin America, Europe, and the United States offer new insights into how democratic institutions have operated within the critical context that marked the political and social life of the region in the last few years: the eruption of popular protest and discontent, the widespread distrust of political institutions, and, of course, the COVID-19 pandemic. Combining different methodological approaches, including cross-national studies, small-N studies, case studies, and quantitative and qualitative data, the contributions cluster around three themes: the problem with fixed terms and other features of presidentialism, inter-institutional relations and executive accountability, and old and new threats to democracy in these times of turmoil. The volume concludes with an assessment of the political consequences of the COVID-19 pandemic in Latin America. Beyond current scholars and students of comparative political scientists, Latin America in Times of Turbulence will be of great interest to a wide spectrum of readers interested in comparative systems of government, democracy studies, and Latin American politics more generally.

Available in PDF, EPUB and Kindle. Book excerpt: The natural wealth of the Amazon and Andes has long attracted fortune seekers, from explorers, farmers, and gold panners to multimillion-dollar mining, oil and gas, and timber operations. Modern demands for commodities have given rise to new development schemes, including hydroelectric dams, open cast mines, and industrial agricultural operations. The history of human habitation in this region is intimately tied to its rich biodiversity, and the Amazon basin is home to scores of indigenous groups, many of whom have populations so small that their cultural and physical survival is endangered. Landscapes of Inequity explores the debate over rights to and use of resources and addresses fundamental questions that inform the debate in the western Amazon basin, from the Andes Mountains to the tropical lowlands. Beginning with an examination of the divergent conceptual interpretations of environmental justice, the volume explores the issue from two interlocking perspectives: of indigenous peoples and of economic development in a global economy. The volume concludes by examining the efficacy of laws and policies concerning the environment in the region, the viability and range of judicial recourse, and future directions in the field of environmental justice.

Book excerpt: This book proposes new perspectives on relational wellness and the contemporary family—combining a psychoanalytic overview with scientific research about the burgeoning popularity of divorce, the increase in “stepfamilies,” and the use of social networks as well as other technologies. In this day and age, psychoanalysis has become increasingly interested in hyper-modern scenarios; for example, social networks and apps provide matching algorithms, which allow users to connect with people of similar interests. These networks have become one of the places where dissatisfied partners seek "more satisfactory situations.” In the United Kingdom, cohabitation lasts for up to two years, on average, and 40% of marriages end in divorce. In the United States, the percentage rises: it has now reached 50%. Today the value of temporariness, in which everything is fragmented, is exalted. On the other hand, is it wrong to deny the natural ebb and flow of human feeling?

Available in PDF, EPUB and Kindle. Book excerpt: This book contributes to the current knowledge and research on conflict and cross-cultural dialogue, emphasizing how respect, tolerance and dialogue may be quite effective tools for bridging the diverse cultures and, consequently, for solving many of the conflicts of today’s world, characterized by a dynamic interchange of populations with very diverse cultural and ethnic backgrounds. For this purpose, we rely on reputed scholars from ten different countries, and from different cultures and fields of expertise, which allows for diverse contributions from a valuable interdisciplinary perspective. The first section of the book deals with the correlation between cultural differences and conflict, while also showing how such conflicts can be prevented and, should they arise, managed and solved. The second section addresses a different, more specific issue: how cultural expression means and tools for cultural communication may lead to conflict whereas they may help to avoid it as well. Finally, the third section analyzes how legal and justice systems deal with cross-cultural conflicts as well as with situations which may lead to cross-cultural conflicts, thus assessing to which extent such systems contribute to avoid and/or solve such kind of conflicts.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides a comparative analysis of how judgments from the European Court of Human Rights (ECtHR) and the Inter-American Court of Human Rights (IACtHR) affect political participation and electoral justice at the national level. Looking at specific countries, the work analyses the legal impact the implementation of the ECtHR and the IACtHR judgments has, with a specific focus on cases in which the regional court concerned uses the “democratic argument,” that is, an argument related to democracy and political rights. The reasoning is that, although democracy is a much wider concept, judgments concerning violations of political rights and electoral justice provide reliable indicators to assess the status and sustainability of democracy in a State. Moreover, the analysis of the violations of political rights and electoral justice allows an in-depth comparison between the two regional human rights systems. Mindful of the broader scope of the fall-out generated by the non-implementation of judgments, including in socio-economic terms, the book includes a section exploring how judgments issued by the ECtHR and the IACtHR affect voters’ participation in the countries under their jurisdiction. To this end, an original dataset including the 47 Member States of the Council of Europe and the 20 countries which recognised the adjudicatory jurisdiction of the IACtHR is built. Multidisciplinary in aim and scope of analysis, the book will be an invaluable resource for researchers, academics, and policy-makers working in the areas of constitutional law, international human rights law, and political economy.

Book excerpt: Exploring the evolution of the right to be forgotten, its challenges, and its impact on privacy, reputation, and online expression, this book lays out the current state of the law on the right to be forgotten in Canada and in the international context while addressing the broader theoretical tensions at its core. The essays contemplate questions such as: How does the right to be forgotten fit into existing legal frameworks? How can Canadian courts and policy-makers reconcile rights to privacy and rights to access publicly available information? Should search engines be regulated purely as commercial actors? What is the right’s impact on free speech and freedom of the press? Together, these essays address the questions that legal actors and policy-makers must consider as they move forward in shaping this new right through legislation, regulations, and jurisprudence. They address both the difficulties in introducing the right and the long-term effects it could have on the protection of online (and offline) reputation and speech. As the question of implementing the right to be forgotten in Canada has been put forward by the Privacy Commissioner and considered by courts, Canada is in need of academic literature on the matter; a need that, with this book, we intend to fulfill. The questions put forward in this book will thus advance the legal debate in Canada and provide a rich case study for the international legal community.

Available in PDF, EPUB and Kindle. Book excerpt: This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.
