Book excerpt: This book contributes to the development of literature on cooperative law while paying tribute to Hagen Henrÿ’s significant impact on this field at a global scale. Hagen Henrÿ is one of the most influential scholars in the field of cooperative law. His primary contribution has been in the area of public international cooperative law. His other areas of scientific interest include development law and comparative law. This honorary volume is focused on two main axes -- the essence of cooperatives as well as their activities and their governance. The contributions throw light on how these two axes are addressed by cooperative legislation across countries, regions and continents. In the varied perspectives that the contributions put together, both a theoretical and practical approach, the authors address central, current and crucial issues for the development of cooperative law. The book is a great resource for researcher scholars, as well as policy makers and industry players interested in the topic.

Book excerpt: The degree of development reached by cooperatives of different sectors throughout the world, which among others led to the UN declaring 2012 as the International Year of Cooperatives, needs to be accompanied by a similar development of corresponding legislation. To this end, a better knowledge of cooperative law from the comparative point of view, as has already been established for other types of enterprises, becomes of great importance. This book strives to fill this gap, and is divided into four parts. The first part offers an analytic and conceptual framework with which to understand, study and assess cooperative law from a transnational and comparative perspective. The second part includes several chapters dealing with attempts to harmonize cooperative laws. The third part contains an overview of more than 30 national cooperative laws, while the last part summarizes and compares these national cooperative laws, thus laying the foundation for a comparative cooperative law doctrine.

Available in PDF, EPUB and Kindle. Book excerpt: Cooperatives are found everywhere, doing all kinds of things. They are critical elements in the economies of a large number of countries around the world, large and small. Their affairs are carried out by elected leadership that runs the gamut from the illiterate to the scholarly. Their membership is made up of people of all socio-economic backgrounds. It is those members who, through their support and their needs, determine the successes and failures of cooperatives. But cooperatives as a popular movement will also be judged in other ways. A judgment will be made on the totality of their impact: local, national, and international. People will ask about how they helped ameliorate the economic and social problems of the dispossessed. But they will also inquire about their influence on economic systems, whether these were made more humane, egalitarian, and inclusive in their benefits because of cooperative principles and practices. Their impact on the international order will be judged collectively by how they contributed more than resolutions to peace, to justice, and to human inclusiveness. This volume provides snapshot views of the cooperative movement in all its diversity. The only single source one can consult to find so much information on the different kinds of cooperatives, significant figures, including philosophers, pioneers, officials, and leaders, and the situation in a large number of countries. With a list of acronyms, an extensive chronology, appendixes, and a comprehensive bibliography.

Book excerpt: The Oxford Handbook of Mutuals and Co-Owned Business investigates all types of 'member owned' organizations, whether consumer co-operatives, agricultural and producer co-operatives, worker co-operatives, mutual building societies, friendly societies, credit unions, solidarity organizations, mutual insurance companies, or employee-owned companies. Such organizations can be owned by their consumers, the producers, or the employees - whether through single-stakeholder or multi-stakeholder ownership. This complex set of organizations is named differently across countries: from 'mutual' in the UK, to 'solidarity cooperatives' in Latin America. In some countries, such organizations are not even officially recognized and thus lack a specific denomination. For the sake of clarity, this Handbook will refer to member-owned organizations to encompass the variety of non-investor-owned organizations, and in the national case study chapters the terms used will be those most widely employed in that country. These alternative corporate forms have emerged in a variety of economic sectors in almost all advanced economies since the time of the industrial revolution and the development of capitalism, through the subsequent creation and dominance of the limited liability company. Until recently, these organizations were generally regarded as a rather marginal component of the economy. However, over the past few years, member-owned organizations have come to be seen in some countries, at least, as potentially attractive in light of their ability to tackle various economic and social concerns, and their relative resilience during the financial and economic crises of 2007-2013.

Book excerpt: Over the past century, an extensive literature has developed, exploring the impact of entrepreneurship on economic performance. The active participation of entrepreneurs in virtually all aspects of business and economic activity has obliged policy makers within the global economy to consider entrepreneurship as a determining variable in any political force, not only for bodies and groups created specifically to this end, but also for any decision-making body. To this end, specific actions promoting entrepreneurship have already been established around the world. However, the particular dynamics of entrepreneurship by women present unique opportunities and challenges. The women’s perspective has often been overlooked in research, practice, and policymaking, and yet yields rich insights and implications. This volume features research from an international array of authors, global data, and in-depth analysis of women’s entrepreneurial activity in Europe, Latin America, the United States, and Canada, to shed light on the positive impact of women’s entrepreneurship on economic growth and development. The first part covers a broad range of concepts relating to the history and context of the female economic perspective. The second part focuses on performance and success factors, with respect to such issues as innovation, social needs, and entrepreneurial orientation. The third part addresses issues of financing, including discussion of access to capital, microcredit, and entrepreneurial behavior. The fourth part considers additional topics, such as work-family balance and access to education. Together, the chapters offer new perspectives on the unique characteristics of women entrepreneurs and their contributions to economic development in theory, practice, and policymaking.

Book excerpt: Infrastructure development presents significant challenges for both developing and developed countries, hindering their progress in achieving the Sustainable Development Goals (SDGs). Governments often struggle to effectively leverage the necessary resources and expertise for financing and managing infrastructure projects, resulting in untapped potential for sustainable and inclusive development. Achieving the Sustainable Development Goals Through Infrastructure Development, edited by Cristina Raluca Gh. Popescu, Poshan Yu, and Yue Wei, offers a comprehensive guide to address these challenges. Focusing on public-private partnerships (PPPs) as a transformative solution, the book equips policymakers, investors, practitioners, and researchers with the essential knowledge and tools needed to navigate the complexities of infrastructure development and leverage the expertise and resources of the private sector. By showcasing successful case studies, analyzing critical success factors, and providing valuable insights into the implementation of PPPs in both developing and developed countries, this book becomes an indispensable resource for driving progress towards the SDGs. Covering crucial topics such as financing, risk management, legal frameworks, and sustainability considerations, it empowers readers to make informed decisions and foster collaborative partnerships between the public and private sectors. Through its comprehensive roadmap, this book enables stakeholders to unlock the full potential of sustainable and inclusive infrastructure development, paving the way for a prosperous future for all.

Available in PDF, EPUB and Kindle. Book excerpt: This open-access book brings together international experts who shed new light on the status of social enterprises, benefit corporations and other purpose-driven companies. The respective chapters take a multidisciplinary approach (combining law, philosophy, history, sociology and economics) and provide valuable insights on fostering social entrepreneurship and advancing the common good. In recent years, we have witnessed a significant shift of how business activities are conducted, mainly through the rise of social enterprises. In an effort to target social problems at their roots, social entrepreneurs create organizations that bring transformative social changes by considering, among others, ethical, social, and environmental factors. A variety of social enterprise models are emerging internationally and are proving their vitality and importance. But what does the term “social enterprise” mean? What are its roots? And how does it work in practice within the legal framework of any country? This handbook attempts to answer these questions from a theoretical, historical, and comparative perspective, bringing together 44 contributions written by 71 expert researchers and practitioners in this field. The first part provides an overview of the social enterprise movement, its evolution, and the different forms entities can take to meet global challenges, overcoming the limits of what governments and states can do. The second part focuses on the emergence of benefit corporations and the growing importance of sustainability and societal values, while also analyzing their different legal forms and adaptation to their regulatory environment. In turn, the last part presents the status quo of purpose-driven companies in 36 developed and emerging economies worldwide. This handbook offers food for thought and guidance for everyone interested in this field. It will benefit practitioners and decision-makers involved in social and community organizations, as well as in international development and, more generally speaking, social sciences and economics.

Available in PDF, EPUB and Kindle. Book excerpt: The private enforcement of competition law through damages actions and/or injunctions before ordinary courts of justice is currently the preferred system in the United States. It is playing an increasingly important role in Europe by supplementing a still predominantly public system based on disciplinary rules enforced by public authorities that do not entail compensation for victims. Compensation can only be achieved through private enforcement, which is already viewed as an alternative to the public system. This work, whose origins lie in the International Conference on the private enforcement of Competition Law held at the University of Valladolid's School of Law offers a comprehensive, pluralist overview of the subject by providing transversal approaches, joint assessment and information on various national experiences alongside more specific contributions that study specific matters of substantive and procedural law, by covering practically all the relevant issues in this field. The work also addresses the main problems of the system vis-à-vis private international law and its connection and interaction with public enforcement. Also available in Spanish language, with the title: La aplicación privada del Derecho de la competencia.
