Book excerpt: Esta investigación ofrece una explicación detallada acerca de las consecuencias que debe afrontar el Estado y el proponente al incumplir los mandatos legales y constitucionales que sirven de fundamento al derecho a la consulta previa en comunidades indígenas en un contrato de obra pública. Bajo esta óptica, la autora fundamenta dichas consecuencias en casos jurisprudenciales y determinaciones gubernamentales en el estudio de los principios y reglas establecidas en torno a la consulta previa. Los argumentos que componen esta investigación analizan en principio el desarrollo histórico de la consulta previa con una descripción del derecho como tal, luego establece las obligaciones que nacen del mismo y, finalmente, determina sus límites en el ordenamiento jurídico. A partir de la teoría establecida, la investigación profundiza en las consecuencias que se presentan cuando el Estado contrata una obra e incumple el deber de realizar la consulta previa de la manera indicada, e identifica los límites establecidos por la jurisprudencia y las decisiones gubernamentales. De esta manera, se proporciona una orientación para entender los puntos clave en la celebración de un contrato de obra pública, cuya ejecución tiene efectos en territorios indígenas, descifrando los elementos que deben darse para reparar a los pueblos indígenas en el caso de incumplimiento de los requisitos para realizar la consulta previa.

This book examines the challenges posed by the modern patent system to the right of everyone to access the benefits of science in international law. Aurora Plomer retraces the genesis and evolution of the key Articles in the UN system (Article 27 UDHR and Article 15 ICESCR). She combines the historiography of these Articles with a novel perspective on the moral foundations of rights of access to science to draw out implications for today’s controversies on patents in the life-sciences. The analysis suggests that access to science as a fundamental right requires both freedom from political and religious interference and the existence of enabling research institutions and educational facilities which promote the flow of knowledge through transparent and open structures. From this perspective, the global patent system is shown to fail spectacularly when it comes to the human rights ideal of universal access to science. The book concludes that a fundamental restructuring of patent institutions is required, in which democratic oversight of patent policies would ensure meaningful realization of the right of everyone to access the benefits of science.
