Book excerpt: This book seeks to make a contribution to the debate on what should be done with the large backlog of war crimes, crimes against humanity and genocide cases in Bosnia and Herzegovina. The paper makes four contributions which the authors consider important elements in the discussion on the responsible management of the backlog of case files: a) basic information on the nature of the war crimes machinery established in Bosnia and Herzegovina; b) its economy; c) an analysis of the requirements of a proper inventory of open war crimes files in the criminal justice system of Bosnia and Herzegovina; and (d) an analysis of criteria for selection and prioritization of war crimes cases. A generic model for the effective mapping of open war crimes files is developed. The analysis of case selection and prioritization criteria compares practise in Bosnia and Herzegovina with that of the International Criminal Tribunal for the Former Yugoslavia and the International Criminal Court. It suggests four clusters of key criteria.

The difference between triggering and preventing these tragic crimes often amounts to the choice between national potential preserved or destroyed. It is also important to recognise that they are not inevitable: the commission of these crimes requires a collective effort, an organisational context, and long planning and preparation. Thus, the idea of strengthening preventative action has taken on greater relevance, and is now encompassed in the emerging notion of 'responsibility to prevent'. International courts and tribunals contribute to this effort by ending impunity for past crimes. Focusing investigations and prosecution on the highest leadership maximises the impact of this contribution. The ICC has an additional preventative mandate which is fulfilled by its timely intervention in the form of preliminary examinations. Moreover, when situations of atrocity crimes are triggered, its complementarity regime incentivises states to stop violence and comply with their duties to investigate and prosecute, thus strengthening the rule of law at the national level. The new role granted to victims by the Rome Statute is key to the ICC ́s successful fulfilment of these functions. This book takes an in-depth look at four countries under scrutiny of the ICC: Afghanistan, Colombia, Libya, and Uganda. It puts forward an analytical framework to assess the impact of the ICC on four levels: on the domestic legal systems (systemic effect); on peace negotiations and agreements (transformative effect); on victims (reparative effect); and on the perceptions of affected populations (demonstration effect). It concludes that the ICC is having a normative impact on domestic legal systems and peace agreements, but it has brought little reparative justice for victims, and it does not necessarily correspond with how affected populations view justice priorities. The book concludes that justice for the world's worst crimes has no 'universal formula' that can easily be captured in law by one institution.
