Jurisprudence has been developed from archaic times by a very slow but distinctly continuous growth. We need not undervalue the labors of analytical jurists, but the fact remains that the historical method is indispensable and becomes the more so as modern research is extended into the origin of all kinds of human life and human institutions. Reference to the views of Professor Paulsen, of Berlin, that law is not an invention of jurists and legislators, but has grown up with the social life of the people as the external form of their union. Originally it is custom; then at a certain stage of development it is separated from the collection of universal obligatory forms of life and action, and becomes a separate field of social compulsion. From that stage on it becomes possibly an object of conscious consideration, and may be even expressed in written statutes and codes and come to look like an artificial product; but whoever considers the subject historically will easily observe that the legal system as a whole is not made. All that is done is to incorporate in a system what has been current and traditional. Occasionally slight adaptations to the changing life and conditions of the people are made. We may say of the legal codes, then, they are not made; they grow. Primitive people did not meet in convention and say, "Let us make a constitution, a civil code, and a code of practice." Such things may be said sometimes today in communities which have behind them thousands of years of legal experience; but even then they can make very little that is new, but generally rearrange and adapt what is immemorially old. Of course the reader will not expect to find in these Commentaries a minute, or even a general survey of all the doc trines belonging to any one branch of Equity Jurisprudence; but such expositions only as may most fully explain the Nature and Limits of Equity Jurisdiction. In order to accomplish even this task in any suitable manner, it has become necessary to bestow a degree of labor in the examination and comparison of authorities, from which many jurists would shrink, and which will scarcely be suspected by those who may consult the work only for occasional exigencies. The work is divided into three great heads. First, the Concur rent Jurisdiction Of Courts of Equity; secondly, the Exclusive Jurisdiction; and thirdly, the Auxiliary or Assistant Jurisdiction. The Concurrent Jurisdiction is again subdivided into two branches the one, where the subject-matter constitutes the principal (though rarely the sole) ground of the jurisdiction; the other, where the peculiar remedies administered in Equity constitute the principal (though not always the sole) ground of Jurisdiction. The present volume embraces the first only Of these branches of Concurrent Jurisdiction. The remaining subjects will be fully discussed in the succeeding volume. I hope also to find leisure to present, as a fit conclusion of these Commentaries, a general review of the doctrines of Equity Pleading, and of the Course of Practice in Equity Proceedings. In dismissing the work to the indulgent consideration of the Profession, I venture to hope that it will not be found, that more has been promised than is performed; and that, if much has been omitted, something will yet be found to lighten the labors of the inquisitive, if not to supply the wants of the learned. Book excerpt: This second selection of articles by George Makdisi concentrates on the schools of religious thought and legal learning in the medieval Islamic world and their defence of ’orthodoxy’. The author aims to review and re-assess the implications of the conflict between, first, the ’rationalist’ and the ’traditional’ theologians (the one accepting the influence of Greek philosophy, the other rejecting it), and then between one of these traditionalist schools - the Hanbali school of law - and Sufi mysticism. One of the most important consequences of the first of these confrontations, he contends, was the emergence of the schools of law as the guardians of the faith and theological orthodoxy. The final section of the book also looks at the structure of legal learning, at the institutions themselves, their organization and the principles upon which they operated. As well as entering the debate over the existence of corporations and guilds of law in classical Islam - maintaining that they did exist - these articles further suggest links between such institutions and the evolution of universities in the medieval West, and the Inns of Court in England, and discuss the Islamic and Arabic contribution to the concepts of academic amd intellectual freedom and to the development of scholasticism and humanism.
