Available in PDF, EPUB and Kindle. Book excerpt: Edward S. Corwin (1878–1963), universally acknowledged to be the most important commentator on the U.S. Constitution in the twentieth century, died before he could write the single definitive work he had planned. Richard Loss has devoted himself to the task of editing a three-volume collection (of which this is the second) of Corwin's major essays on the Constitution. The seventeen essays in Volume II focus on Article III (the judicial article) of the Constitution. They were, in Corwin's judgment, among his most important works. Thus this volume is a sequel both to Volume I, which treated Articles I and II of the Constitution, and to Presidential Power and the Constitution, in which Loss gathered most of Corwin's essays on the presidency. The editor has organized the essays under the headings "The Origins of Judicial Review," "The Development of Judicial Supremacy," "The Exercise of Judicial Review," and "Appraisals of Judicial Review." Each essay is reprinted in its entirety, including footnotes.

Book excerpt: The writings of Edward S. Corwin not only cover a vast array of political developments from the first half of the twentieth century, but also reveal Corwin's oftentimes deep personal involvement in those events. Kenneth Crews' compilation of Corwin's most important essays makes a critical and unique contribution to the literature of American politics and law. Although many of Corwin's books came from well-known publishing houses and many of his essays appeared in familiar journals, many of his most important contributions to political thought were published in local newspapers, foreign periodicals, and other publications no longer easily available to many scholars. Such essays constitute the foundation of this book: Corwin's writings about the New Deal and Court-packing, his year in China, his ambiguous support for Woodrow Wilson, and his kind words for Eisenhower and Nixon in the 1950s. These essays also reveal a prominent scholar taking strong positions on political events, from the decision to enter World War I to the challenges of democracy under the threat of atomic war and expanding presidential powers.

Corwin's text has been a basic reference in the study of U.S. Constitutional Law. The 14th edition, the first new edition since 1973, brings the volume up to date through 1977. In this classic work, historian Edward Corwin presented the text of the U.S. Constitution along with his own commentary on its articles, sections, clauses, and amendments. Corwin was a renowned authority on constitutional law and jurisprudence, and was hired at Princeton University by Woodrow Wilson in 1905. Far from being an impersonal textbook, Corwin's edition was full of opinion. Not afraid to express his own strong views of the development of American law, Corwin offered piquant descriptions of the debates about the meaning of clauses, placing recent decisions of the court "in the familiar setting of his own views." The favor of his style is evident in his comments on judicial review ("American democracy's way of covering its bet") and the cabinet ("an administrative anachronism" that should be replaced by a legislative council "whose daily salt does not come from the Presidential table"). Corwin periodically revised the book for nearly forty years, incorporating into each new edition his views of new Supreme Court rulings and other changes in American law. Although Corwin intended his book for the general public, his interpretations always gained the attention of legal scholars and practitioners. The prefaces he wrote to the revised editions were often controversial for the views he offered on the latest developments of constitutional law, and the book only grew in stature and recognition. After his death in 1963, other scholars prepared subsequent editions, fourteen in all.

Available in PDF, EPUB and Kindle. Book excerpt: Edward S. Corwin is the twentieth century's most eminent commentator on the Constitution. Unfortunately, he died before he could write the single definitive work on the Constitution he had planned. In three volumes, of which this is the first, Richard Loss has edited and introduced major essays by Corwin that best delineate his argument in political thought and constitutional law. The essays in Volume One examine the foundations of American political and constitutional thought, the powers of Congress, and the President's power of removal. Corwin addresses topics that vary from "The Worship of the Constitution" to "The Constitution as Instrument and Symbol." He discusses the lessons of the Constitutional Convention of 1787, takes up the relationship of the Constitution to New Deal democracy, and examines democratic dogma and political science. A fascinating essay treating the theory of evolution shows how this idea replaced the idea of natural law in American constitutional tradition. Loss's introduction provides a biographical sketch of Corwin, elaborates and appraises his argument and characterizes Corwin's legacy to the present generation of scholars. Loss shows that far from ending debate, Corwin's essays on political thought and the removal power establish an intellectual agenda for further inquiry into the tenets of constitutional law. In an epilogue Loss deals with Corwin's understanding of Alexander Hamilton's position on the President's removal power, an important topic involving not only presidential prerogative, but the comparative rank of Hamilton's Federalist papers on the presidency and Hamilton's Pacificus letters. Corwin on the Constitution will be of particular interest to judges, historians, law teachers, political scientists, students of constitutional law and American political thought.

Largely because Corwin died before he could write the single definitive work he had planned, the political scientist Richard Loss has spent over a decade compiling and editing a three-volume collection of Corwin's major essays. Loss has chosen twelve essays for the final volume that state Corwin's arguments in political thought and constitutional law. They are responsive to the theme of limitations on governmental power. The editor has organized the essays under the headings "The Limits of Governmental Power over Property and Business," "Governmental Action and Personal and Social Rights," and "A Nation and the States." He has also included Corwin's spirited and previously unpublished address "The New Deal in the Light of American Political and Constitutional Ideas."

This book was released on 2013-02-22 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: Chief Justice John Roberts stunned the nation by upholding the Affordable Care Act--more commonly known as Obamacare. But legal experts observed that the decision might prove a strategic defeat for progressives. Roberts grounded his decision on Congress's power to tax. He dismissed the claim that it is allowed under the Constitution's commerce clause, which has been the basis of virtually all federal regulation--now thrown in doubt. In The Tough Luck Constitution and the Assault on Health Care Reform, Andrew Koppelman explains how the Court's conservatives embraced the arguments of a fringe libertarian legal movement bent on eviscerating the modern social welfare state. They instead advocate what Koppelman calls a "tough luck" philosophy: if you fall on hard times, too bad for you. He argues that the rule they proposed--that the government can't make citizens buy things--has nothing to do with the Constitution, and that it is in fact useless to stop real abuses of power, as it was tailor-made to block this one law after its opponents had lost in the legislature. He goes on to dismantle the high court's construction of the commerce clause, arguing that it almost crippled America's ability to reverse rising health-care costs and shrinking access. Koppelman also places the Affordable Care Act within a broader historical context. The Constitution was written to increase central power, he notes, after the failure of the Articles of Confederation. The Supreme Court's previous limitations on Congressional power have proved unfortunate: it has struck down anti-lynching laws, civil-rights protections, and declared that child-labor laws would end "all freedom of commerce, and . . . our system of government [would] be practically destroyed." Both somehow survived after the court revisited these precedents. Koppelman notes that the arguments used against Obamacare are radically new--not based on established constitutional principles. Ranging from early constitutional history to potential consequences, this is the definitive postmortem of this landmark case.
