Available in PDF, EPUB and Kindle. Book excerpt: Anti-corruption measures have firmly taken centre stage in the development agenda of international organisations as well as in developed and developing countries. One area in which corruption manifests itself is in public procurement and, as a result, States have adopted various measures to prevent and curb corruption in public procurement. One such mechanism for dealing with procurement corruption is to debar or disqualify corrupt suppliers from bidding for or otherwise obtaining government contracts. This book examines the issues and challenges raised by the debarment or disqualification of corrupt suppliers from public contracts. Implementing a disqualification mechanism in public procurement raises serious practical and conceptual difficulties, which are not always considered by legislative provisions on disqualification. Some of the problems that may arise from the use of disqualifications include determining whether a conviction for corruption ought to be a pre-requisite to disqualification, bearing in mind that corruption thrives in secret, resulting in a dearth of convictions. Another issue is determining how to balance the tension between granting adequate procedural safeguards to a supplier in disqualification proceedings and not delaying the procurement process. A further issue is determining the scope of the disqualification in the sense of determining whether it applies to firms, natural persons, subcontractors, subsidiaries or other persons related to the corrupt firm and whether disqualification will lead to the termination of existing contracts. The book compares and contrasts the legal, practical and institutional approaches to the implementation of the disqualification mechanism in the European Union, the United Kingdom, the United States, the Republic of South Africa and the World Bank.

Book excerpt: 'Corruption' in public procurement typically involves procurement decisions taken in favour of preferred bidders in exchange for improper compensation (the acceptance of bribes, for example), while supplier collusion refers to a type of cartel activity, in which firms rig their bids in a tendering process. Although these practices are distinct, they frequently occur together in the public procurement context, reinforcing one another. Combatting Corruption and Collusion in Public Procurement: A Challenge for Governments Worldwide examines the causes of corruption and collusion in the public procurement sphere, its resulting harm, and how states can best try to combat these practices. This book provides a legal, economic, and practical analysis of issues concerning corruption and supplier collusion in public procurement, both generally and in seven diverse and representative jurisdictions: the United Kingdom, the United States, Brazil, Hungary and Poland, Ukraine, and Canada. It encompasses a discussion of both 'generic' cross-jurisdictional issues and specific proposals for individual jurisdictions. It offers practical guidance on building robust regimes for combatting corruption and collusion in public procurement and how to bolster and improve them when they are faltering. The book stresses the need for a multi-faceted and joined-up approach to the problems, emphasizing the importance both of enhanced investment in the effective enforcement of anti-corruption and cartel laws and of increasing the resilience of public procurement systems to corruption and collusion through a range of measures. The relevance of the topic to the social and economic well-being of citizens and the survival of democratic governance is highlighted throughout the book. Pioneering and comprehensive, Combatting Corruption and Collusion in Public Procurement provides a pathbreaking analysis of a range of global issues, making it an essential read for scholars, lawyers, government officials and representatives of international and non-governmental organizations around the world.

Available in PDF, EPUB and Kindle. Book excerpt: The Routledge Handbook of Public Procurement Corruption showcases the most innovative and exciting research being conducted in this important area of study, providing a comprehensive go-to reference for all who are interested in the topic. During the COVID-19 pandemic, the global race for health and ancillary goods amid global supply chain disruptions demonstrated that, when tested, all countries are incredibly vulnerable to fraud and corruption in public procurement, irrespective of their level of development. Yet despite the widespread nature of the problem, there remains a lack of in-depth, analytical, and cross-country investigations into public procurement corruption. This book addresses this gap by providing a comprehensive, multidisciplinary, geographically balanced treatise on corruption in public procurement. It combines country-specific studies to allow readers to easily compare differing perspectives and approaches and overarching thematic chapters to reflect on new and cutting-edge issues in procurement and their implications for procurement corruption. Key sectors such as healthcare and infrastructure are considered, as well as the role of new technologies, in both combatting and enabling procurement corruption. This Handbook provides academics, practitioners, and graduate researchers of public administration, law, and anti-corruption with all of the tools they need to understand the nuances of public procurement corruption around the world.

Book excerpt: This book establishes a nexus between corruption in public procurement and the prevailing crisis of governance in Africa. The African continent is characterised by the growing concern for the deteriorating human security. In the midst of these woes, African political leaders are known for their stupendous wealth and riches through expropriation of national resources for personal benefits. This growing inequality in the continent has become a major driver for a series of violent and criminal activities, which have added to the worsening governance crisis. Thus, the abuse of public power for advancing private gain constitutes an impediment to effective public service delivery, thereby engendering a crisis of governance. The consequence of this is not limited to the socio-economic growth and welfare of citizens, but it often also jeopardizes the democratic credentials and objectives of the state.

Book excerpt: Master's Thesis from the year 2018 in the subject Economics - International Economic Relations, grade: 1,0, Wiesbaden University of Applied Sciences, language: English, abstract: Corruption erodes the functioning of a state's essential organs, meaning its political, economic and social structures, and causes its norms and values to deteriorate, but more severely, it ultimately weakens the heart of good governance - the most feared enemy of corruption. Weakened by this disease, the state, however powerful its systems, becomes more vulnerable and exposed to a great variety of risk factors while the malicious disease increasingly thrives, spreading through the organism and capturing the state, trapping it in a vicious circle. There is no country that is immune to this disease. Whether on the local, national or international stage, corruption wreaks its destructive work at all political, economic and social levels. Public procurement embodies a large, if not the largest part of national economies. Every year, trillions of dollars are deployed for the acquisition of goods, services and works, ranging from those intended to serve basic needs such as education or public health services to those destined for giant infrastructure projects; the latters', large budgets make them tempting targets for corruption, which is often shielded behind the complicated and opaque procurement process. This results in wasteful spending, transforming public procurement, a powerful instrument for the promotion of prosperous economic development, into a harmful growth inhibitor. Public procurement belongs to the group of government activities that are worst affected by corruption. Corruption, seen as a key governance challenge, puts a detrimental strain on the functioning of a sound public procurement system. A public procurement system affected by corruption suffers from a wide range of symptoms; for instance, the quality of public projects may be reduced and public funds may be diverte

Book excerpt: This book presents an extensive study on the extant constructs of corruption in infrastructure-related projects and aims to contribute to the determination and elimination of its incidence and prevalence in infrastructure projects. The book conducts a comprehensive examination of the various determining factors of corruption that negatively affect the procurement process and, in the end, result in cost and time overruns. The authors present an in-depth understanding of how the identified determining factors of corruption can be addressed. Thus, it is intended to broaden the reader's knowledge of the causes, risk indicators, and different forms of corrupt practices in the procurement process of infrastructure works, before explaining how they affect its stages and activities A dynamic model is developed to demonstrate how to tackle the overall impact of corruption within the procurement process and, at the same time, increase the effectiveness of the extant anti-corruption measures. In short, this book demonstrates that the fight against corruption in the procurement process is strategically feasible and must continue. This book is essential reading for academics, researchers, professionals and stakeholders in the procurement of infrastructure projects and civil works, as well as those with an interest in corruption, construction management and construction project management.
