Um dos principais se encontra no artigo 12, que reconhece a capacidade legal das pessoas com deficiência em igualdade de condições com as demais em todos os aspectos da vida e determina a criação de sistemas fundados no apoio ao exercício dessa capacidade; e não em sua restrição. Tendo em vista as dúvidas levantadas nos últimos anos pela doutrina e pela jurisprudência acerca do tema, esta obra se propõe a desvendar o que significa, afinal, a capacidade legal positivada no texto convencional e quais as repercussões que advêm de seu reconhecimento. Uma segunda parte da obra é alicerçada na metodologia de direito comparado, tendo sido eleitos os ordenamentos de Brasil e Portugal para essa empreitada. Ambos os países promulgaram legislações internas que alteraram de maneira significativa a disciplina das incapacidades (Lei 13.146/2015, no Brasil; e Lei 49/2018, em Portugal), e, com amparo nas reformas legislativas, na doutrina e na jurisprudência, o objetivo é compreender em que medida os dois sistemas jurídicos se adequaram (ou não) às diretrizes desenhadas pelo controverso artigo 12. Entende-se que a comparação é de grande valia para a investigação, buscando-se colher na experiência estrangeira pistas para avaliar, em concreto, o melhor desenho para um regime de incapacidades sob a égide da CDPD.
