Book excerpt: Comparative Law for Spanish–English Speaking Lawyers provides practitioners and students of law, in a variety of English- and Spanish- speaking countries, with the information and skills needed to successfully undertake competent comparative legal research and communicate with local counsel and clients in a second language. Written with the purpose of helping lawyers develop the practical skills essential for success in today’s increasingly international legal market, this book aims to arm its readers with the tools needed to translate unfamiliar legal terms and contextualize the legal concepts and practices used in foreign legal systems.

Available in PDF, EPUB and Kindle. Book excerpt: This book analyzes the whole path to justice: from the decision to enter the path to justice until justice is achieved and applies a mixed-methods approach using quantitative and qualitative data. It deliberately takes the consumer’s perspective and, beyond the scope of existing studies, does not only take into account the existence of mechanisms and forums to claim justice, but their appropriateness for vulnerable target groups. The book sheds more light on microfinance and other vulnerable clients who, due to existing barriers, cannot access grievance, redress or complaint mechanisms. Eliminating these access barriers would cater to the achievement of the 16th Sustainable Development Goal by increasing vulnerable consumers’ Access to Justice. This book will be of interest to academics researching access to justice, researchers focusing on consumer protection issues in developing countries, and practitioners working in financial inclusion.

Available in PDF, EPUB and Kindle. Book excerpt: The feeling of insecurity is a little known phenomenon that has been only partially explored by social sciences. However, it has a deep social, cultural and economic impact and may even contribute to define the very structures of the state. In Latin America, fear of crime has become an important stumbling block in the region’s process of democratization. After long spells of dictatorships and civil wars, violence in the region was supposed to be under control yet crime rates have continued to skyrocket and citizens remain fearful. This analytical puzzle has troubled researchers and to date there is no publication which explores this problem. Based on a wealth of cutting edge qualitative and quantitative research, Lucía Dammert proposes a unique theoretical perspective which includes a sociological, criminological and political analysis to understand fear of crime. She describes its linkages to issues such as urban segregation, social attitudes, institutional trust, public policies and authoritarian discourses in Chile’s recent past. Looking beyond Chile, Dammert also includes a regional comparative perspective allowing readers to understand the complex elements underpinning this situation. Fear and Crime in Latin America challenges many assumptions and opens an opportunity to discuss an issue that affects everyone with key societal and personal costs. As crime rates increase and states become even more fragile, fear of crime as a social problem will continue to have an important impact in Latin America.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents, analyses and evaluates the Principles of Latin American Contract Law (PLACL), a recent set of provisions aiming at the harmonisation of contract law at a regional level. As such, the PLACL are the most recent exponent of the many proposals for transnational sets of 'principles of contract law' that were drafted or published over the past 20 years, either at the global or the regional level. These include the UNIDROIT Principles of International Commercial Contracts, the Principles of European Contract Law, the (European) Draft Common Frame of Reference and the Principles of Asian Contract Law. The PLACL are the product of a working group comprising legal academics from Argentina, Brazil, Colombia, Chile, Paraguay, Uruguay and Venezuela. The 111 articles of the instrument deal with problems of general contract law, such as formation, interpretation and performance of contracts, as well as remedies for breach. The book aims to introduce the PLACL to an international audience by putting them in their historical and comparative context, including other transnational harmonisation measures and initiatives. The contributions are authored by drafters of the PLACL and contract law experts from Europe and Latin America.

Available in PDF, EPUB and Kindle. Book excerpt: Is popular culture merely a process of creating, marketing, and consuming a final product, or is it an expression of the artist's surroundings and an attempt to alter them? Noted Argentine/Mexican anthropologist Néstor García Canclini addresses these questions and more in Transforming Modernity, a translation of Las culturas populares en el capitalismo. Based on fieldwork among the Purépecha of Michoacán, Mexico, some of the most talented artisans of the New World, the book is not so much a work of ethnography as of philosophy—a cultural critique of modernism. García Canclini delineates three interpretations of popular culture: spontaneous creation, which posits that artistic expression is the realization of beauty and knowledge; "memory for sale," which holds that original products are created for sale in the imposed capitalist system; and the tourist outlook, whereby collectibles are created to justify development and to provide insight into what capitalism has achieved. Transforming Modernity argues strongly for popular culture as an instrument of understanding, reproducing, and transforming the social system in order to elaborate and construct class hegemony and to reflect the unequal appropriation and distribution of cultural capital. With its wide scope, this book should appeal to readers within and well beyond anthropology—those interested in cultural theory, social thought, and Mesoamerican culture.
