Book excerpt: Presidential impeachment, Bush v. Gore, the authorization for military tribunals to try American civilians for criminal offenses, executive privilege squabbles with courts and Congress, the rise and fall of the line-item veto ? it is impossible to overstate the significance of the interbranch confrontations that have promised to revolutionize separation of powers understandings since the mid-1990s.In Separation of Powers Law, Second Edition, Professors (and former law deans) Shane and Bruff have updated their treatment of this critical area to encompass these and other dramatic issues, such as the impact of 9/11 on the law of electronics surrveillance and the capacity of the executive branch to withhold sensitive information on national policy grounds. The books retains its clear structure and historical perspective, plus an emphasis on the ethical challenges posed for constitutional lawyers in the executive and legislative branches seeking to address novel constitutional issues in professionally appropriate ways. The authors continue to introdcue key episodes not only through judicial decisions, but also through administrative orders and memoranda, opions of the Attorney General and the Office of Legal Counsel, and legislative documents, presenting a broad spectrum of the kinds of legal materials that government lawyers actually consult.

Book Synopsis The Federal Budget by : Allen Schick
Download or read book The Federal Budget written by Allen Schick and published by Brookings Institution Press. This book was released on 2008-05-31 with total page 362 pages. Available in PDF, EPUB and Kindle. Book excerpt: The federal budget impacts American policies both at home and abroad, and recent concern over the exploding budgetary deficit has experts calling our nation's policies "unsustainable" and "system-dooming." As the deficit continues to grow, will America be fully able to fund its priorities, such as an effective military and looking after its aging population? In this third edition of his classic book The Federal Budget, Allen Schick examines how surpluses projected during the final years of the Clinton presidency turned into oversized deficits under George W. Bush. In his detailed analysis of the politics and practices surrounding the federal budget, Schick addresses issues such as the collapse of the congressional budgetary process and the threat posed by the termination of discretionary spending caps. This edition updates and expands his assessment of the long-term budgetary outlook, and it concludes with a look at how the nation's deficit will affect America now and in the future. "A clear explanation of the federal budget... [Allen Schick] has captured the politics of federal budgeting from the original lofty goals to the stark realities of today."—Pete V. Domenici, U.S. Senate

Book Synopsis The Constitution and the Attorneys General by : Jefferson Powell
Download or read book The Constitution and the Attorneys General written by Jefferson Powell and published by . This book was released on 1999 with total page 752 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the beginning of the Republic, the President's chief advisor in the interpretation of the Constitution has been the Attorney General. The opinions of the Attorneys General on constitutional topics are official statements of the executive branch's views, and in many circumstances where a constitutional question cannot come before a court, their opinions provide the final answer. This book offers the most important constitutional opinions of the Attorneys General and the Department of Justice from Edmund Randolph (President Washington's first Attorney General) to Janet Reno. Powell's commentary provides biographical and historical context to enhance the reader's appreciation of the opinions, which cover such topics as the separation of powers, the authority of Congress and the President over matters of war and peace, the nature of citizenship, and the executive's responsibilities with respect to statutes that the President believes unconstitutional. The opinions are presented in full text and with original pagination, making The Constitution and the Attorneys General a fully independent research tool. A variety of indices and tables give the reader full access to the executive branch's two-century-long tradition of construing and applying the Constitution. "A superb and invaluable source book for graduate students in political science, historians, and legal scholars." -- CHOICE Magazine
Book Synopsis Presidential Spending Power by : Louis Fisher
Download or read book Presidential Spending Power written by Louis Fisher and published by Princeton University Press. This book was released on 2015-03-08 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: Each year billions of dollars are diverted by the President and his assistants from the purposes for which Congress intended them. Billions more are used in confidential and covert ways, without the knowledge of Congress and the public. Here is the first account of how this money is actually spent. Louis Fisher writes: "When it comes to the administration of the budget, we find nothing that is obvious, very little that is visible. Our priorities here are peculiar. We fix upon the appropriations process, watching with great fascination as Congress goes about its business of making funds available to agencies. What happens after that point —the actual spending of money—rarely commands our attention." To unravel the mystery, Louis Fisher has investigated different forms of discretionary action: the transfer of funds that initially financed the Cambodian incursion; impoundment during the Nixon administration; covert financing; the reprogramming of funds; and unauthorized commitments. He describes each of these devices in operation and provides the historical background of Presidential spending power. In conclusion Louis Fisher presents a cogent and timely analysis of what can be done to improve Congressional control. Sufficient control, he maintains, cannot be achieved merely through the appropriations process, and he makes important recommendations designed to preserve discretionary authority while improving Congressional supervision.
