Available in PDF, EPUB and Kindle. Book excerpt: Originally published: Cambridge: Cambridge University Press, 1908. xxviii, 547 pp. Although Maitland never intended to publish these lectures, they have long been regarded as one of the best introductions to the English Constitution. Delivered in the winter of 1887 and spring of 1888, and edited and published in 1908 by one of Maitland's students, Herbert A.L. Fisher, they cover the period from 1066 to the end of the nineteenth century. Rather than a narrative historical format, they focus on describing the work of the constitution during five distinct moments in English history: 1307, 1509, 1625, 1702 and 1887. They provide an entry to some of the major concepts he later expounded in his seminal work written with Sir Frederick Pollock, The History of English Law. Widely considered the father of modern legal history, FREDERIC WILLIAM MAITLAND 1850-1906] was an English jurist and historian best known for The History of English Law Before the Time of Edward I (1895), written with Sir Frederick Pollock. He was educated at Eton and Cambridge and studied at Lincoln's Inn, London. Maitland was called to the bar in1876 and practiced until 1884, when he became a reader in English law (1884) and professor (1888) at Cambridge. He founded the Selden Society in 1887. Hailed for his original outlook on history, his works had a profound influence on legal scholarship and remain important today.

Book excerpt: Excerpt from Studies in Constitutional Law: France, England, United States In introducing the book in an English form to readers unable to enjoy the French original, I can confidently recommend it to the attention of students. The work was originally composed for Frenchmen; hence the author occasionally insists upon features in the English Constitution which to Englishmen may appear to be too well known to require notice or explanation. But the fact that the essay is written by a foreigner for foreigners, though it may seem at first sight to limit the utility of the book for: English students, is in reality one of its great recommendations. Book excerpt: Excerpt from Constitutional History of England Of the compendious general histories of the English con stitution, T. P. Taswell-langmead's is the most satisfactory on the whole for American use, but numerous revisions have affected practically only the most recent periods, and much Of the narrative depends too exclusively on the statutes. Its great advantage is that it presents a continuous chronol ogical account and that the detail is full. D. J. Medley's is more accurate in the earlier portions and has been kept abreast Of recent legislation, but it treats the subject top ically rather than in its chronological development. F. W. Maitland's is based on the lectures given by Professor Mait land at Cambridge in 1887 and 1888, and is full of sugges tion for the teacher. It presents the subject in cross sec tions at five important epochs. J. Hatschek's Englische Verfassungsgeschichte is valuable as giving the views of a foreign scholar and treats of many topics not usually cov ered elsewhere. It has full bibliographies. R. Gneist's History of the English Constitution, translated by P. A. Ashworth, is still useful, especially for facts not commonly given. J. A. R. Marriott's English Political Institutions, though concerned chiefly with present institutions, is helpful in tracing their historical antecedents. Book excerpt: Excerpt from The Origin of the English Constitution It is hardly necessary to point out to Americans that the history of the origin of the English Constitu tion is our history as much as it is the history of living Englishmen. Our institutional past until near the close of the seventeenth century is to be found in England alone. This f act the history of the seven teenth century shows clearly enough, f or if one will stu dy the constitutional innovations attempted or advocated during the period of Puritan rule, when the constitutional life of England abandoned for a moment all connexion with the monarchy, he will see how natural it seemed to the nation to turn to a sur prising number of the political expedients which in our government seem departures from the English system. When Englishmen at home broke with their own institutional precedents, and began to make a republic, it was to things of this kind that their minds were naturally led, as if they had been trained to them. Book excerpt: Excerpt from Documents of the Constitution of England and America: From Magna Charta to the Federal Constitution of 1789 While teaching the elements of Constitutional History and Law to successive classes in college, I have felt the want of a little manual, which should present in a form convenient for reference, the text, not only of our own national Constitution, but of those state documents, whether pertaining directly to the history of England or of America, upon which some of the most important features of our Constitution are based, and from which, both in the spirit and the letter, it may be said to derive its parentage. The word Constitution, in its largest sense, properly signifies the aggregate of those fundamental laws, institutions, and usages, which make up the whole polity of a state. It is too extensive, therefore, to be accurately described and defined in a single written instrument; a great portion of it is unwritten, forming a body of consuetudinary law, which is equally valid with those other portions that have been specially recognized and enacted, or re-enacted rather, by the supreme legislature. What is usually termed the Constitution in this country, whether it be the Federal Constitution of the whole Union, or the separate Constitution of each State, is but a part, and a small part, of the fundamental law under which we live. Still more; these two specific constitutions are not, to any great extent, original and fresh enactments, first devised and first made binding when these were put together and formally accepted by the people about three quarters of a century ago. Book excerpt: Excerpt from The English Constitution We commonly think, I believe, that the coining of money is an economic function of Government; that the Government verifies the quality and quantity of metal in the coin out of regard to the good of its subjects, and that Government is admirably suited to this task - that it is a very reliable verifier. But in truth, if we look at the real motives of Governments, and the real action of Governments, we may come to think otherwise.
