Book excerpt: Excerpt from Constitutional Conflict in Provincial Massachusetts: A Study of Some Phases of the Opposition Between the Massachusetts Governor and General Court in the Early Eighteenth Century It is necessary, first; to examine the two Opposing govern mental principles whose interaction is the key to the constitutional history of the provincial period. Three-quarters of a century of neglect by the home government had given the infant colony opportunity to develop in its own way, its form determined by the fact of organization as a corporation; but even this form was disregarded when the central purpose of the enterprise demanded the assumption of powers not usual among corporations. Under the guidance of two generations of determined, aristocratic Pur itans Massachusetts had become a theocracy, its sovereignty vested in the freemen of the Massachusetts Bay Company, whose power was concentrated, with the consent of the church members, in the hands of the rulers of the Congregational church. This Company, originally organized with an English corpora tion's powers for trade, land-holding, and colonization, had been transplanted to America, where it became merged in the colony by the admission of the prominent resident colonists to the cor poration. It gradually forsook its natural original functions, and became merely a political body, exercising as its chief reason for being the power to governe and rule,1 which had been intended to be merely incidental to the more ordinary powers of colony-planting, land-holding, and trading. Book excerpt: The minimum of violence accompanying the success of the American Revolution resulted in large part, argues this book, from the conditions of law the British allowed in the American colonies. By contrast, Ireland's struggle for independence was prolonged, bloody, and bitter largely because of the repressive conditions of law imposed by Britain. Examining the most rebellious American colony, Massachusetts Bay, Professor Reid finds that law was locally controlled while imperial law was almost nonexistent as an influence on the daily lives of individuals. In Ireland the same English common law, because of imperial control of legal machinery, produced an opposite result. The Irish were forced to resort to secret, underground violence. The author examines various Massachusetts Bay institutions to show the consequences of whig party control, in contrast to the situation in 18th-century Ireland. A general conclusion is that law, the conditions of positive law, and the matter of who controls the law may have more significant effects on the course of events than is generally assumed.

King and People in Provincial Massachusetts explores what monarchy meant to Massachusetts under its second charter and why the momentous change to republican government came about. Richard L. Bushman argues that monarchy entailed more than having a king as head of state: it was an elaborate political culture with implications for social organization as well. Massachusetts, moreover, was entirely loyal to the king and thoroughly imbued with that culture. Why then did the colonies become republican in 1776? The change cannot be attributed to a single thinker such as John Locke or to a strain of political thought such as English country party rhetoric. Instead, it was the result of tensions ingrained in the colonial political system that surfaced with the invasion of parliamentary power into colonial affairs after 1763. The underlying weakness of monarchical government in Massachusetts was the absence of monarchical society -- the intricate web of patronage and dependence that existed in England. But the conflict came from the colonists' conception of rulers as an alien class of exploiters whose interest was the plundering of the colonies. In large part, colonial politics was the effort to restrain official avarice. The author explicates the meaning of "interest" in political discourse to show how that conception was central in the thinking of both the popular party and the British ministry. Management of the interest of royal officials was a problem that continually bedeviled both the colonists and the crown. Conflict was perennial because the colonists and the ministry pursued diverging objectives in regulating colonial officialdom. Ultimately the colonists came to see that safety against exploitation by self-interested rulers would be assured only by republican government.
