Book excerpt: In the wake of proliferating discourses around globalisation and culture, some central questions around cultural politics have acquired a commonsensical and hegemonic character in contemporary intellectual discourse. The politics of difference, the possibilities of hybridity and the potential of multiple liminalities frame much discussion around the transnational dimensions of culture and post-identity politics. In this volume, the economic, political and social consequences of the focus on ‘culture’ in contemporary theories of globalization are analysed around the disparate fields of architecture, museum discourse, satellite television, dub poetry, carnival and sub-national theatre. The discourses of hybridity, diaspora, cultural difference minoritization are critically interrogated and engaged with through close analysis of cultural objects and practices. The essays thus intervene in the debate around modernity, globalization and cultural politics, and the volume as a whole provides a critical constellation through which the complexity of transnational culture can be framed. Thinking through the particular, the essays limn the absent universality of forms of capitalist globalization and the volume as a whole provides multiple perspectives from which to enter the singular modernity of our times in all its complexity.

As a consequence, theories and models have been developed which are aimed at conceptualising this new reality along the lines of an ‘institutionalised’ World Culture. This offers a new understanding of the worldwide diffusion of specifically modern – i.e. mainly Western – rules, ideologies and organisational patterns, and of attendant harmonisation and standardisation of fields of social action. World Culture theories have not gone unchallenged. Rather, cross-cultural studies have revealed much more complex processes of regional fragmentation and (re-)diversification; of the refraction, appropriation, and hybridisation, through distinct socio-cultural conditioning, of world-level models and ideas; and of the ongoing effectiveness both of structural path-dependencies and of specifically cultural aspects such as collective memories, social meanings, and religious (or ideological) belief systems. Comparative research has thus highlighted an intricate simultaneity of contrary currents: of the increasing world-level interconnection of communication and exchange relations on the one hand, and, on the other, the persistence of context-specific interpretations, translations, and deviation-generating re-contextualisations of world-level forces and challenges. This research provides the theoretical problematique that animates this volume. The chapters explore the conceptual tools and explanatory power of theories and models which do not just oppose or reject World Culture theory, but are instead suited to complementing and differentiating it. The volume offers an enlightening conceptualisation of the intricate interaction of global processes with local agency, and of world-level forces with the self-evolutionary potentials inherent in specific contexts, socio-cultural structures, and distinctive meanings constellations. This book was originally published as a special issue of Comparative Education.

How can intractable transnational regulatory conflicts be solved? The book complements a close analysis of regulatory frameworks and case law with a more encompassing perspective on the political, socio-economic and distributional implications of different approaches to the regulation of health and environmental risks at times of globalisation. The GMO deadlock thus becomes a lens through which to investigate the underlying value systems, goals, and impacts of transnational discourses on risk governance. Against this backdrop, the normative strand of analysis points to the limited ability of science and procedural deliberation to generate authentic agreement and to identify normatively legitimate solutions, in the absence of pre-existing shared perspectives.

However, the current regulation remains quite blind to the so called "transnational heritage". This is heritage where there is no community recognized in law that it can be directly attributed to and that can be responsible for its safekeeping and preservation. It can also be items of heritage where the claim of ownership is disputed between two or more peoples or communities. Transnational heritage challenges the idea of monolithic, mono-cultural, ethno-national states. There are a number of examples of such cultural heritage, for instance the Buddhist Bamiyan statutes in Afghanistan, Palmyra in Syria, the Jewish heritage of Iraq, or various items that are currently housed in large, often Western, museums, as a result of colonial practices. This book explores the regulation of transnational heritage. By discussing many cases of transnational heritage and the problems that arise due to the lack of regulation the book analyses the manifestations of memories and constructions of communities through heritage. It focuses particularly on the concept of community. How are communities constructed in cultural heritage law and what falls outside of the definitions of community? The book underlines that the issues surrounding transnational heritage involve more than a communal right to culture. It is argued that transnational heritage also directly affects wider matters of law such as citizenship, human rights, sovereignty, as well as the movement of people and cultural goods.
