It is the single best book written by an American in the nineteenth century on the meaning of our political way of life." A second edition of Grimke's work was published in 1856, and a third edition appeared posthumously in 1871, but since then this classic in American thought has been almost completely lost to sight. Grimke was born in South Carolina in 1791, and later moved to Ohio where he became a judge. He remained a bachelor, led a rich and cosmopolitan intellectual life, and accumulated an excellent library. His sisters Angelina (wife of the abolitionist Theodore Weld) and Sarah were both famous for deserting their South Carolina heritage and becoming active in the abolition and woman suffrage movements. In 1842 Grimke retired from the bench to devote the remainder of his life to study and writing, setting himself the task of educating his contemporaries in the nature of their society. His major achievement was The Nature and Tendency of Free Institutions. Grimke's range of topics includes the right of the majority, the character and operation of elective governments, the function of political parties, the American contrasted with the English and French constitutions, and the separation of powers in the American political systems. He sees governmental institutions as the expression of the general structure of society which calls them into being. In his Introduction, Mr. Ward points to Grimke's thesis "that the separation of powers in the frame of the American constitution works not because power is distributed within the government but because all branches of the government are, directly or indirectly, responsible to the will of the majority of the people outside the doors of government." As a result of the party system, Grimke wrote, "we may vary the paraphernalia of government as much as we please, but it still obstinately persists in every one of its departments to be a government based upon the popular will." Mr. Ward calls attention to Grimke's passionate belief that "freedom is its own justification" and that its ultimate value is that "it created the kind of character which made freedom possible." He held that "the only way to make a man fit for freedom is to give him freedom." Yet, unlike his sisters, he shared a view of race that was pervasive in his time and was unable to imagine the extension of freedom to the slave. In contradiction to his views of government and freedom, he upheld Negro slavery even to the extent of sanctioning secession to protect it. To him, "the open affirmation of the right of secession would serve to maintain the Union, not destroy it."

Book excerpt: Excerpt from Considerations Upon the Nature and Tendency of Free Institutions The reason then why it is of so much importance to examine and understand the structure of society, and not merely the machinery of government, is because at the present day, more than at any former period, the political institutions are molded by the manners. It is true, every form of government may strictly be said to depend upon the constitution of society upon the social organization in which it has taken root. But this dependence is of a totally different character, in different countries. In some, the manners exert a positive influence while In others, they have properly a negative influence only. In a commonwealth, where the standard of popular intelligence 1s high, and no impediment exists to the exercise of that popular authority which rightfully springs from such a state, the people may truly be said to create and to uphold the government. On the contrary, where the population is sunk in ignorance and apathy, government assumes the character of a self existing institution, for there IS no power beyond to direct and control it. In one instance, the will of society impresses itself as an active power upon the institutions, both ordaining and controlling them: in the other, for defect of will, the government is simply permitted to be what chance, or circumstances, originally made it. The political institutions of Russia, and the United States, equally depend upon the social organization; but in the former the influence is negative, in the latter it is direct and positive. Book excerpt: Frederick Grimke is the last person anyone including scholars who have recounted the careers of his two sisters Sarah and Angelina in the nineteenth century feminist movement would have suspected of having a sympathetic interest in womens rights. An intellectual with quietly held opinions on secession and slavery reflecting his antebellum southern heritage, who spent the last two decades of his life pursuing interests in political theory, he was famous among fellow townsmen for his aversion to female company. But his affection for his sisters and his admiration for what they had achieved in their public careers inspired this essay, The Rights of Women in a Democratic Republic, in which he made a remarkably prescient forecast of the vocational future of American women including married women with children once given access to higher education. The essay was nearly lost. Grimke himself had doubts about it, and after appealing to Sarah to help him resolve them, died in 1863 leaving an instruction that it be omitted from the edition of all his writings which his executor published in 1871, in a cheaply fabricated volume with very small distribution. Melhorns Epilogue reveals who the executor was, and how he came to disobey the order for the essays suppression. With new research findings revealing Grimkes influence on his sister Sarahs writings, and the discovery of feminist issues as an undergraduate debate topic at Yale where he was educated, Melhorns Commentary broadens the scope of the history of womens rights in America.
