This final rule implements the final conservation and management measures in Amendment 5a to the 2006 Consolidated HMS FMP for sandbar, scalloped hammerhead, blacknose, and Gulf of Mexico blacktip sharks. This final rule also announces the revised 2013 annual regional quotas for aggregated large coastal sharks (LCS), hammerhead, Gulf of Mexico blacktip, blacknose, and non-blacknose small coastal sharks (SCS). These changes could affect all commercial and recreational fishermen who fish for sharks in the Atlantic Ocean, the Gulf of Mexico, and the Caribbean Sea. Book excerpt: Fisheries for highly migratory species are important in all oceans and semi-enclosed seas, except for polar regions. Fisheries for straddling fish stocks are much more localised, primarily occurring in a few regions where continental shelves extend beyond the 200 miles Exclusive Economic Zone (EEZ), while most fisheries for other high seas fishery resources are deep-water fisheries. This publication examines issues relating to the stocks of these resources, including information on their state of exploitation. Findings include that about 30 percent of the stocks of highly migratory tuna and tuna-like species, more than half of highly migratory oceanic sharks and nearly two-thirds of the straddling stocks and the stocks of other high seas fishery resources are overexploited or depleted. Although the stocks concerned represent only a small fraction of the world fishery resources, they are key indicators of the state of an overwhelming part of the ocean ecosystem which appears to be more overexploited than EEZs.

These resources account for as much as one-third of world marine capture fishery harvests. This paper explores the legal and economic aspects of the management of each of the several different categories of shared stocks, namely transboundary, highly migratory, straddling and discrete high seas stocks. The economics of the issue point to the conclusion that, with few exceptions, effective cooperation between and among states is a fundamental prerequisite for sustainable resource management.
