Available in PDF, EPUB and Kindle. Book excerpt: Presents a new paradigm for informed consent based on autonomous, reflective, rational, substantially understood medical treatments that are substantially disclosed to the patient. The author redefines the physician-patient relationship as an equal partnership between two individuals with the common goal of improving overall health and well-being. She argues that if this view is acknowledged and practiced by the medical community, it will lesson the burdens of achieving an effective informed consent which is based on an autonomously derived decision by the patient. Book excerpt: Consent is used in many different social and legal contexts with the pervasive understanding that it is, and has always been, about autonomy – but has it? Beginning with an overview of consent’s role in law today, this book investigates the doctrine’s inseparable association with personal autonomy and its effect in producing both idealised and demonised forms of personhood and agency. This prompts a search for alternative understandings of consent. Through an exploration of sexual offences in Antiquity, medical practice in the Middle Ages, and the regulation of bodily harm on the present-day sports field, this book demonstrates that, in contrast to its common sense story of autonomy, consent more often operates as an act of submission than as a form of personal freedom or agency. The book explores the implications of this counter-narrative for the law’s contemporary uses of consent, arguing that the kind of freedom consent is meant to enact might be foreclosed by the very frame in which we think about autonomy itself. This book will be of interest to scholars of many aspects of law, history, and feminism as well as students of criminal law, bioethics, and political theory.

Book excerpt: Surgeons have a duty to provide accurate information before asking for consent for surgery, and patients are increasingly interested in obtaining as much information as possible regarding their procedures. Consent in Surgery addresses these vital areas, outlining the consent process for common surgical procedures, including indications, benefits, risks/complications, alternative treatment options, a brief description of each procedure and summaries of the relevant scientific evidence. It contains procedures from subspecialties including cardiothoracic surgery, neurosurgery, general surgery, paediatric surgery, plastic and reconstructive surgery, trauma and orthopaedic surgery, otolaryngology and urology. The procedures included fall within the Intercollegiate Surgical Curriculum Project and MRCS syllabi, and are assessed during higher specialist training, making the book an essential revision and interview preparation tool. 'Helpful to all surgeons in their general approach to this issue and to those in each of the specialties with regard to specific operations.' - From the Foreword by John Black 'A welcome guide, written by authoritative voices and of digestible length. This volume on consent should be in every ward library, close to hand for the ever more rapidly changing teams managing surgical patients.' - From the Foreword by Tim Goodacre

Book excerpt: This current and timely volume presents new thinking and new directions in feminist legal scholarship. Rethinking key concepts in legal feminism, Cowan and Hunter provide a unique examination of key socio-legal concepts in law, jurisprudence and legal and political theory. Written by an international cast of contributors, offering different cultural perspectives as well as doctrinal and theoretical knowledge, this collection of essays presents a dialogue between different feminist positions and approaches to a common theme. It addresses a range of questions, including: Can 'consent' be rethought and infused with different meanings in a post-liberal feminist politics? Can the concepts of 'choice' and 'consent' have consistent meanings and functions between different areas of law, or whether they prove to be highly contingent when viewed across the broad field of law. Exploring the deeply gendered concepts of ‘choice’ and ‘consent’ and examining the philosophical and jurisprudential issues surrounding them as well as how ‘choice’ and ‘consent’ operate in particular areas of law, including criminal law, medical law, constitutional law, employment law, family law and civil procedure, this volume is a key resource for postgraduate law students studying jurisprudence.

Available in PDF, EPUB and Kindle. Book excerpt: Teen films of the 1980s were notorious for treating consent as irrelevant, with scenes of boys spying in girls' locker rooms and tricking girls into sex. While contemporary movies now routinely prioritize consent, ensure date rape is no longer a joke, and celebrate girls' desires, sexual consent remains a problematic and often elusive ideal in teen films. In Consent Culture and Teen Films, Michele Meek traces the history of adolescent sexuality in US cinema and examines how several films from the 2000s, including Blockers, To All the Boys I've Loved Before, The Kissing Booth, and Alex Strangelove, take consent into account. Yet, at the same time, Meek reveals that teen films expose how affirmative consent ("yes means yes") fails to protect youth from unwanted and unpleasant sexual encounters. By highlighting ambiguous sexual interactions in teen films--such as girls' failure to obtain consent from boys, queer teens subjected to conversion therapy camps, and youth manipulated into sexual relationships with adults--Meek unravels some of consent's intricacies rather than relying on oversimplification. By exposing affirmative consent in teen films as gendered, heteronormative, and cis-centered, Consent Culture and Teen Films suggests we must continue building a more inclusive consent framework that normalizes youth sexual desire and agency with all its complexities and ambivalences.

Book excerpt: Phil Fennell's tightly argued study traces the history of treatment of mental disorder in Britain over the last 150 years. He focuses specifically on treatment of mental disorder without consent within psychiatric practice, and on the legal position which has allowed it. Treatment Without Consent examines many controversial areas: the use of high-strength drugs and Electro Convulsive Therapy, physical restraint and the vexed issue of the sterilisation of people with learning disabilities. Changing notions of consent are discussed, from the common perception that relatives are able to consent on behalf of the patient, to present-day statutory and common law rules, and recent Law Commission recommendations. This work brings a complex and intriguing area to life; it includes a table of legal sources and an extensive bibliography. It is essential reading for historians, lawyers and all those who are interested in the treatment of mental disorder.
