Book excerpt: 'This is a very timely book which provides an unprecedented analysis of the factors which have shaped the competition law systems of ten Asian countries and Australia. The comprehensive discussion from varying viewpoints against the backdrop of the significantly different environments within which the respective regimes have developed creates a framework for the comparative assessment of competition law systems elsewhere in the world.' Lutz-Christian Wolff, The Chinese University of Hong Kong 'New competition laws have been adopted throughout Asia in recent years, and some of the older laws have been significantly strengthened. This makes Asia a fascinating region in which to look at the political and economic circumstances of the countries in which such laws are to be found, and to consider the very different conditions that exist within them. This book will be an invaluable guide to anyone with an interest in the developing competition law regimes of this immensely important part of the world.' Richard Whish, King's College London, UK This detailed book describes and analyses the essential political economy features that provide the backdrop to the competition policies and competition law regimes of several of the most important Asian economies. The book also discusses the impact of these political economy influences in determining whether the adopted competition policy is effective. Each of the authors experts in their respective countries offer specific insights into the nature and structure of their competition regimes and discuss to what extent the varied political economy factors unique to that country help to determine whether and to what extent the established system promotes or hinders economic competition in that jurisdiction. Comprising wide coverage of Asian jurisdictions, including Australia, this book will strongly appeal to students and academics of law, politics, economics and economic development, policy makers in national governments, international agencies and competition authorities, as well as practicing competition lawyers and in-house counsel.

Available in PDF, EPUB and Kindle. Book excerpt: This book is important from the public policy and foreign investment points of view and should be read by all who need to understand the competitive policies in the ASEAN Countries. As the author has rightly pointed out, the narrow capitalistic model to maximize profits even at the expense of income distribution, has been modified in ASEAN countries, to take into account the need for equity and distributive justice. The socio economic strategy has been essential, to pomote political stability, without which there cannot be economic growth and development. The book argues impressively that competition policy cannot be unfettered, but has to be efficiently and compassionately managed, to ensure balanced business and steady socioeconomic development. Competitive policies have to follow the best interests of developing economies and not just the pressures and preferences of the capitalistic competitive policies of the highly developed industrial countries, that often ignore the different priorities of developing countries.

Available in PDF, EPUB and Kindle. Book excerpt: In an age in which it is increasingly necessary for nations to consider their competitiveness and at a time when the world economy is facing recession, this book explores the possible trajectory of ASEAN arguably one of the most dynamic areas in the world as a regional economic and political bloc. This important and timely study focuses on the role of foreign direct investment in advancing the performance of ASEAN and the competitiveness of its firms, whereas other studies typically focus solely on the role of trade. The expert contributors an interdisciplinary assembly of economists, lawyers and political scientists present a comprehensive view of ASEAN s experiences over the past decade, addressing the industrial competitiveness of ASEAN and analysing the role of MNEs against the background of the challenges of integration. They illustrate that regional integration will only be a success if ASEAN s linkages are broadened with global partners through negotiations of Free Trade Agreements. The book concludes that although much still remains to be done, and many promises are still to be unveiled, ASEAN s coming of age is an historic milestone. Competitiveness of the ASEAN Countries will appeal to a broad readership including students, academics and researchers with an interest in Asian studies, international business, international economics and international law.

Available in PDF, EPUB and Kindle. Book excerpt: Globalization and structural adjustment offer many opportunities for export orientated industrialization in developing economies. As a group, competitiveness in the developing countries has improved, but, while East Asian economies have had rapid export growth and technological upgrades, South Asian and African economies have lagged behind. Old structures, institutions, behavioural patterns and public policies are ill-adapted to deal with the challenges posed by technological change and economic liberalization. Consequently there is an urgent need for change in government and private sector attitudes and strategies. This volume seeks to generalise the lessons across developing country and enterprise cases, and sheds light on which trade and industrial strategies and instruments work best, and which do not work, in relation to manufacturing competitiveness.

Book excerpt: Annotation In developing countries and emerging economies, traditional industrial practices can be linked to policy changes which foster innovation, but can equally result in stagnation if the policy/practice mix is wrong. These case studies -- from Brazil, Chinese Taipei, India and Korea -- demonstrate that where industrial habits tend to reduce competitiveness, policies can make a difference. The book opens a fresh debate on the industrial policies developing countries need to adopt to compete and grow in a globalized economic environment.

Book excerpt: Economic challenges in developing Asian countries have become more complex: urban populations are growing at great cost to the environment, climate change has increased risks of natural disasters, and income gaps within and between developing countries are widening. These factors threaten the sustainable growth and development of urban areas, the drivers of Asia's economy. A strategic approach for inclusive growth is needed. The City Cluster Economic Development approach provides a strategic framework and a set of analytical tools, which governments, businesses, and communities can use to support the inclusive and sustainable development of competitive urban economies in Asia. Said approach was developed and tested by the Asian Development Bank to improve the basis for integrated planning and development of urban regions in Asia and the Pacific. It also elps urban managers and other city stakeholders identify action plans and determine priority investment areas.

Book excerpt: Attempts to measure competitiveness (CP) across countries have typically neglected the world¿s smallest economies. Hence, a simple composite index, the Small State Manufactured Export CP Index or SSMECI, was developed to benchmark industrial CP. The SSMECI represents the first attempt to provide a comprehensive picture of the CP performance of small states. The performance of small states varies across geographical regions, income groups, & country size classes. High-performing small states had better macroeconomic conditions, higher levels of foreign invest., more trade openness, better levels of educ., & modern infrastructure. A coherent, market-oriented CP strategy in small states is vital to success on international markets. Tables.

Book excerpt: Global competition now shapes economies and societies in ways unimaginable only a few years ago, and competition (or 'antitrust') law is a key component of the legal framework for global competition. These laws are intended to protect competition from distortion and restraint, and on the national level they reflect the relationships between markets, their participants, and those affected by them. The current legal framework for the global economy is provided, however, by national laws and institutions. This means that those few governments that have sufficient 'power' to apply their laws to conduct outside their own territory provide the norms of global competition. This has long meant that the US (and, more recently, the EU) structure global competition, but China and other countries are increasingly using their economic and political leverage to apply their own competition laws to global markets. The result is increasing uncertainty, costs, and conflicts that burden global economic development. This book examines competition law on the global level and reveals its often complex and little-understood dynamics. It focuses on the interactions between national and international legal regimes that are central to these dynamics and a key to understanding them. Part I examines the evolution of the current global system, the factors that have shaped it, how it operates today, and recent efforts to alter that system-e.g., by including competition law in the WTO. Part II focuses on national competition law systems, revealing how national laws and experiences shape global competition law dynamics and how global factors, in turn, shape national laws and experiences. It examines the central roles of US and European law and experience, and it also pays close attention to countries such as China that are playing increasingly important roles in the global competition law arena. Part III analyzes current strategies for improving the legal framework for global competition and identifies the factors that may contribute to a system that more effectively supports global economic and political development. This analysis also suggests a pathway for moving toward that goal.
