S. was also against the validity of the marriage but the court approved both rules saying: "I had occasion to consider the subject fully, of what will constitute marriage in this state; certainly, by our law, marriage is regarded only as a civil contract, and whatever is sufficient evidence of the assent of the parties' minds to enter into that relation, establishes a marriage. This may be either per verba de prcesenti, "I take you for my wife," etc., or per verba de futuro, an agreement to marry in future, with subsequent cohabitation. Where parties agree to marry in future, and afterwards cohabit, the law infers that this cohabitation was an execution of the previous agreement." Certainly the latter part of this statement needs explanation. The court cited absolutely no authority. In 1842 Greenleaf published his work on evidence. He says: "Marriage is a civil contract, jure gentium, to the validity of which the consent of the parties, able to contract, is all that is required by natural or public law. If the contract is made per verba de prcesenti, though it is not consummated by cohabitation, it amounts to a valid marriage, in the absence of all civil regulations to the contrary. (Citing Kent and Fenton v. Reed.) Gfreenleaf's treatise on evidence was a great piece of work and his statement did much to further the doctrine. This is an overstatement; social reform has many approaches, and we could ill afford to dispense with a single one of them. It does happen, however, that the plan of study to which the present Digest is merely preliminary grew out of social case work in one of the large family agencies of New York, and that this brief study illustrates, in a fashion, the relation between the social worker's attempt to find a way out for a few people in grievous trouble and human issues of wider significance. I have served for several years on the committee of a society for family social work to which have been referred its especially puzzling problems of individual welfare. In about three-fifths of all the cases so referred, the committee found that the core of the difficulty centered around marital maladjustments. (Their proportion in the whole work of the society, it should be added, would not be nearly so large.) These troubles of the Smiths, the Browns, and the Robinsons brought more forcibly to our attention than ever before certain ancient evils and certain proposed remedies. As a part of the general public, we had already noted the alarming increase in the number of divorces, but we had never fully realized before the close relation between divorce and our ill-devised, variously-administered marriage laws. We began to wonder why so much attention had been given to the defects of our divorce laws and so little to those regulating marriage. Of course, law is only a small part of the problem as compared with public education and early training, yet it shapes our social ideals, in part at least, besides having much to do with the practical adjustments of daily living. To those who champion one wholesale remedy for marital unhappiness, the plans growing out of this committee work - plans for a series of brief studies to be made by the Russell Sage Foundation - will seem futile. Down to the year 1884, marriage disputes, even those involving the validity of marriages already contracted, were, as a rule, decided, with us, by the bishop, or also by rectors of parishes, and sometimes even by assistant priests, without any judicial formalities whatever. This mode of procedure was naturally open to serious inconveniences, and was calculated to imperil, in many cases, the stability and indissolubility of marriages. To obviate these disadvantages, the S. C. de Prop. Fide, in 1884, issued the Instruction Causae Matrimoniales for this country. This Instruction or law substantially lays down and makes obligatory here, in matrimonial contentions involving the validity of a marriage contracted, the manner of proceeding which is prescribed by the general law of the Church and obtains throughout the entire Church. This mode of deciding marriage disputes is judicial, and is to be conducted by the bishop's court for marriage causes. In some respects the judicial formalities of the marriage process are the same as those of other ecclesiastical trials. But in no small number of points there are wide divergencies between the two. From the very nature of the subject-matter in dispute, the marriage trial has many peculiarities, and is frequently more intricate and complex than other ecclesiastical trials.
