Book excerpt: Excerpt from Institutes of American Law, Vol. 1 of 2 Most lawyers have felt the want of a preliminary work to serve the young American student as a guide in the labyrinth of jurisprudence; as an instructor to give him a general view of the several parts of this judicial science; to mark the objects of each, and to point out the natural dependence which unites them; a work tending to establish a method which should be adopted in the study of the law; to point out the numerous links of the chain which unites the ancient with the modern law, which binds the past with the present, and which by its nature must for ever remain indestructible. A work which would thus elevate the science of the law in the sight of youth, and impress a character of unity upon it, would exercise a happy influence on the minds of the students, develop their moral and intellectual faculties, and be a blessing to them. But it is far less difficult to describe what the legal edifice should be, and to state what is required for its construction, than to select the materials of which it should be composed, and to make such a disposition of them in the building as would render the structure at once solid, elegant, and every way fitted for the purpose for which it is intended. On entering on his profession, the American student is discouraged by being obliged to study laws which are not his own, and which do not belong to the present age, except as matter of history. It requires an effort to read even the elegant Blackstone, and, when studied, it must be forgotten, because the laws on which that author has so beautifully commented are not the laws which the young aspirant seeks to know - they are not those of his country. It is true, noble efforts have been made by American writers to explain our laws, and to them the profession must be greatly indebted; but the commentaries which have been so liberally bestowed are better adapted to the use of those who are already good lawyers, than to teach one who has every thing to learn. The author cannot hope to have made a perfect work, and supplied, in this respect, all the deficiencies and the wants of the profession; his aim has been an approximation to what a work should be which might, in some degree, deserve the title of Institutes of American Law. He has endeavored to reduce the whole to a strict method, and, by a correct classification, to impress upon the mind of the student the objects of his inquiry; for, what is well classified is half known. It seemed to him that jurisprudence, as much as any other science, required this method; and while all kinds of human knowledge are now taught in this manner the law should not be an exception. Book excerpt: Excerpt from Blackstone's Commentaries: Abridged The object of this edition has been to retain all the conspicuous and acknowledged merits of the Commentaries in their unabridged form, while the defects and imperfections which impair the usefulness of the work are carefully removed. Obsolete matter, which is of no historical value as regards the development of the law as a scientific system of principles, has been omitted, wherever this could be done without destroying the connection of thought. The chapters which relate to the English form of government, as for example, those treat ing of the King's Royal Family, the King's Revenue, etc., have also been omitted, as of no importance to the American student in an elementary treatise upon the general principles of the common law. Subjects insufficiently developed in the original work are discussed in the copious notes v hich are appended to the text. This book was released on 2017-09-18 with total page 508 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Commentaries on the Laws of England was a four volume set intended to bring England's common law into a realm of understanding for the average citizen. The second volume, presented here, details the rights of 'things'. Blackstone's work was credited as being the first since the Middle Ages to methodically examine the laws of England. His work is credited with helping to lay the foundation for the American legal system. This volume examines the laws surrounding property and ownership. It is the longest volume of the set, and deals extensively with real property as well as chattel property. The work is presented without an introduction, but is preceded by a table of contents and concluded with a detailed index. As it was upon its original publication, The Commentaries on the Laws of England remains a surprisingly readable text. It is for this reason that Blackstone's work became so influential in the first place, as this feature made his books accessible by the layperson. While the first volume of the set may prove more interesting for some readers, as it details the rights of persons, this volume is still fascinating for its insight into a feudal society's perspective of property. The Commentaries on the Laws of England was a monumental text upon its original publication, and remains a work of great historical significance. Anybody interested in legal history, particularly in the British or American realms, will find this to be an important and fascinating read. Book excerpt: Excerpt from The Complete Works of Edward Livingston on Criminal Jurisprudence, Vol. 2 of 2 No act of legislation can be or ought to be immutable. Changes are required by the alteration of circumstances; amendments, by the imperfection of all human institutions; but laws ought never to be changed without great deliberation, and a due consideration as well of the reasons on which they were founded, as of the circumstances under which they were enacted. It is therefore proper, in the formation of new laws, to state clearly the motives for making them, and the principles by which the framers were governed in their enactment Without a knowledge of these, future legislatures cannot perform the task of amendment, and there can be neither consistency in legislation, nor uniformity in the interpretation of laws. For these reasons, the general assembly of the state of Louisiana declare that their objects in establishing the following code, are - To remove doubts relative to the authority of any parts of the penal law of the different nations by which this state, before its independence, was governed. To embody into one law, and to arrange into system, such of the various prohibitions enacted by different statutes as are proper to be retained in the penal code. To include in the class of offences, acts injurious to the state and its inhabitants, which are not now forbidden by law. It includes ordinary revolts on board American ships, on the one hand, and, on the other, forcing, with malice, and without justifiable cause, any Of our Officers or seamen on shore, and leaving them behind in any foreign port or place. Great vigilance in ferreting out and punishing both of these crimes is demanded, as well, on the one hand, to protect the hardy and honest seaman from oppression while abroad, as, on the other, to enable the commanders of vessels to preserve due subordination, and save from shipwreck and destruction the valuable property and lives intrusted to their charge. It includes, likewise, setting on fire our vessels of war, or wilfully casting away Ships belonging to citizens of the United States. Outrages Of this description, whether committed on the high seas or at home, are alike punishable here. Without deeming it necessary, at this time, to enter more at large into the character of these crimes, I shall next invite your attention to a catalogue Of Offences resting on another peculiarity in our politi cal system. Book excerpt: The classic exposition of English Common Law at the time of the founding of the American Republic was Commentaries on the Laws of England, by William Blackstone. This work was used as a standard reference and law book by lawyers, judges, and the founding fathers, who incorporated the applicable provisions of it into the U.S. Constitution, especially for the definitions of its terms. However, Blackstone's Commentaries were written for a monarchical system of government, and needed to be adapted to the needs of the new republic. This was first done by St. George Tucker, who taught law and who had Blackstone's Commentaries republished together with his own lecture notes in 1803 in a five-volume set familiarly known as Tucker's Blackstone.
