Book excerpt: L‘avenir du travail en Afrique se penche sur deux questions fondamentales : comment créer des emplois productifs et comment subvenir aux besoins des laissés-pour-compte. Le rapport met en lumière comment l’adoption des technologies numériques, conjuguée à d’autres phénomènes mondiaux, transforme la nature du travail en Afrique subsaharienne et pose un défi en même temps qu’elle crée de nouvelles possibilités. Les auteurs montrent que les nouvelles technologies ne sont pas simplement synonymes de destruction d’emplois, comme on le craint généralement, mais qu’elles peuvent permettre aux pays africains de construire un monde du travail inclusif et offrir des opportunités aux travailleurs les moins qualifiés. Pour exploiter ces opportunités, cependant, il est indispensable de mettre en place des politiques publiques et de réaliser des investissements productifs dans quatre domaines principaux. Il faudra notamment promouvoir des technologies numériques inclusives, développer le capital humain d’une main-d’oeuvre jeune, globalement peu qualifiée et qui s’accroît rapidement, augmenter la productivité des entreprises et des travailleurs du secteur informel et élargir la couverture de la protection sociale pour atténuer les risques liés aux bouleversements du marché du travail. Le présent rapport, prolongement du Rapport sur le développement dans le monde 2019 de la Banque mondiale, aborde en conclusion d’importantes questions de politique publique qui viendront alimenter de futurs travaux de recherche permettant de guider les pays africains sur la voie d’une croissance plus inclusive.

After almost three decades of deregulation driven by a belief in the self-equilibrating properties of the market, the financial crisis of 2008 has reminded everyone of the fundamental truth that markets have legal and institutional foundations, without which they cannot effectively function. The chapters in the present volume are the result of work by a group of legal scholars which began in the mid-2000s, at a time when the shortcomings of deregulatory policies were becoming clear in a number of contexts. The chapters address the question of how the language of contract law describes or conceptualises the market order and the relationship of the law to it. The perspectives taken are, in turn, historical, comparative, and context-specific. The focus of the book is on a foundational idea, the concept of capacitas, which signifies a status conferred upon citizens for the purpose of enabling them to participate in the economic life of the polity. In modern legal systems, 'capacity' is the principal juridical mechanism by which individuals and entities are empowered to enter into legally binding agreements and, more generally, to arrange their affairs using the instruments of private law. Legal capacity is thereby the gateway to involvement in the operations of a market economy.

L’usager devient un client que les entreprises s’efforcent de fidéliser. Le travail, plus autonome, est aussi plus soumis à des normes strictes. Comment s’articulent aujourd’hui emploi et travail ? Quelles conséquences sont susceptibles d’avoir les formes nouvelles d’emploi sur le contenu du travail ? Que signifie la qualité de l’emploi ? Sur la base d’enquêtes récentes, l’auteur dresse le tableau de ce qui relève des deux ordres de préoccupation, et démontre la nécessité de repenser leur nécessaire articulation afin de prendre la mesure des changements à l’œuvre. This book tests the hypothesis that plural agreement with collective nouns is becoming more frequent in French. Through an analysis of data from a variety of sources, including sociolinguistic interviews, gap-fill tests and corpora, the complex linguistic and external factors which affect this type of agreement are examined, shedding new light on their interaction in this context.
