Most contemporary metaphysicians would answer "no" to each of these questions. The book considers the views of natural law theorists ranging from Blackstone to Dworkin and rejects them, arguing that it is not conceptually necessary that the criteria of legal validity include moral norms. Further, it rejects the exclusive positivist view, arguing instead that it is conceptually possible for the criteria of validity to include moral norms. In the process of considering such questions, this book considers Raz's views concerning the nature of authority and Shapiro's views about the guidance function of law, which have been thought to repudiate the conceptual possibility of moral criteria of legal validity. The book, then, articulates a thought experiment that shows that it is possible for a legal system to have such criteria and concludes with a chapter that argues that any legal system, like that of the United States, which affords final authority over the content of the law to judges who are fallible with respect to the requirements of morality is a legal system with purely source-based criteria of validity.

The phenomenon of category mistakes is particularly interesting to both these fields because a plausible case can be (and has been) made for explaining it in terms of syntax, semantics, and pragmatics—making it a fruitful case for exploring the relations between and nature of these three fundamental realms of language. Category Mistakes follows this division. After an introduction which explains the aims and motivations for the project and provides a brief historical survey of the (modern) treatment of category mistakes in each of philosophy, linguistics, and computer science, Magidor discusses four approaches in turn: first, the syntactic approach, which maintains that category mistakes are syntactically ill-formed; then two semantic approaches, though ones that appeal to different semantic facets: the meaninglessness view, which maintains that category mistakes are meaningless, and the MBT view, according to which category mistakes are meaningful but truth-valueless; and finally the pragmatic approach, according to which category mistakes are syntactically well-formed, meaningful, truth-valued but nevertheless pragmatically inappropriate. Magidor argues that the first three approaches ought to be rejected, and in the final chapter addresses the main challenge by developing and defending a particular version of the pragmatic approach: a presuppositional account of category mistakes.

Game theory helps to highlight the evolution of morality as a resolution of interpersonal conflicts under strategic negotiation. It is this emphasis on strategic negotiation that underwrites the idea of consent. Consent theory differs from other contractarian models by abandoning reliance on rational self-interest in favour of evolutionary adaptation. From this, more emphasis will be placed on consent as natural convergence rather than consent as an idealization. My picture of contractarianism, then, ends up looking more like the relativist model offered by Harman, rather than the rational (or pseudo-rational) model offered by Gauthier, let alone the Kantian brands of Rawls or Scanlon. So at least some of my discussion will dwell on why it is no loss to abandon hope for the universal, categorical morality that rational models promise. In the introduction, I offer the betting analogy that underwrites the remaining picture. There are some bets where the expected utility is positive, though the odds of winning on this particular occasion are exceedingly low. In such cases, we cannot hope to give an argument that taking the bet is rational. The only thing we can say is that those predisposed to take this kind of bet on these kinds of occasions will do better than those with other dispositions, so long as such games occur often enough.

Against this background I con sider notions of observation, meaning, and regulative standards. My position is in opposition to some widely influential and current views. Revolutionary new ideas concerning the philosophy of science have recently been advanced by Feyerabend, Hanson, Kuhn, Toulmin, and others. There are differences among their views and each in some respect differs from the others. It is, however, not the differences, but rather the similarities that are of primary concern to me here. The claim that there are pervasive presuppositions fundamental to scientific in vestigations seems to be essential to the views of these men. Each would further hold that transitions from one scientific tradition to another force radical changes in what is observed, in the meanings of the terms employed, and in the metastandards involved. They would claim that total replace ment, not reduction, is what does, and should, occur during scientific revolutions. I argue that the proposed arguments for radical observational variance, for radical meaning variance, and for radical variance of regulative standards with respect to scientific transitions all fail. I further argue that these positions are in themselves implausible and methodologically undesirable. I sketch an account of the rationale of scientific change which preserves the merits and avoids the shortcomings of the approach of radical meaning variance theorists.
