This book was released on 2015-07-01 with total page 660 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Cases on the Law of Partnership, Including Limited Partnerships, Selected From Decisions of English and American Courts For years past the science of law has been taught by lectures, the use of text-books and more recently by the detailed study, in the class-room, of selected cases. Each method has its advocates, but it is generally agreed that the lecture system should be discarded because in it the lecturer does the work and the student is either a willing receptacle or offers a passive resistance. It is not too much to say that the lecture system is doomed. Instruction by the means of text-books as a supplement or substitute for the formal lecture has made its formal entry into the educational world and obtains widely; but the system is faulty and must pass away as the exclusive means of studying and teaching law. It is an improvement on the formal lecture in that the student works, but if it cannot be said that he works to no purpose, it is a fact that he works from the wrong end. The rule is learned without the reason, or both rule and reason are stated in the abstract as the resultant rather than as the process. If we forget the rule we cannot solve the problem; if we have learned to solve the problem it is a simple matter to formulate a rule of our own. The text-book method may strengthen the memory; it may not train the mind, nor does it necessarily strengthen it. A text, if it be short, is at best a summary, and a summary presupposes previous knowledge. If, however, law be considered as a science rather than a collection of arbitrary rules and regulations, it follows that it should be studied as a science. Thus to state the problem is to solve it; the laboratory method has displaced the lecture, and the text yields to the actual experiment. The law reports are in more senses than one books of experiments, and, by studying the actual case, the student co-operates with the judge and works out the conclusion however complicated the facts or the principles involved. A study of cases arranged historically develops the knowledge of the law, and. each case is seen to be not an isolated fact but a necessary link in the chain of development. The study of the case is clearly the most practical method, for the student already does in his undergraduate days what he must do all his life; it is curiously the most theoretical and the most practical. Several new sections have been added, the Uniform Partnership Act has been incorporated, and the range of citation of cases has been somewhat extended; otherwise its scope and purpose have not been changed. This book was released on 2017-10-11 with total page 748 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Handbook on the Law of Partnership, Including Limited Partnerships The original arrangement with the publishers contem plated, not an entirely new treatise on the law of Partner ship, but merely a new edition of Mr. William George's' text on this subject. After the work was begun, however, it seemed advisable to abandon Mr. George's text for the most part, and to prepare a substantially new treatise, us ing such portions of his work as should be found suitable. With the exception, therefore, of Chapters VIII and IX, the present book, both in arrangement and text, is new. A few passages and a number of citations and notes have been taken from Mr. George. Chapters VIII and IX are repro duced substantially as found in Mr. George's book, with the addition of later cases. The law on the subject being rea sonably well worked out in the authorities, the aim of the present author has been to make a clear and definite state ment of the leading principles, in a form serviceable alike to students and practitioners. Whatever merit the book has lies in this direction, rather than in the discussion of controverted points, or the advancement of new theories. The citations, while including all the leading cases, are not exhaustive, but are sufficiently full for practical purposes. The author acknowledges his great indebtedness for valua ble assistance in the task to Mr. Henry A. Hirshberg and to Mr. Oliver S. Rundell; also to Mr. Olcott O. Partridge for his preparation of the chapter on Limited Partnerships. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Handbook of the Law of Partnership The aspect of the partnership relation nas undergone many chang es during the century now closing. These changes have been traced and explained in the text, while. In the notes, the reader has been referred to the leading cases and the best text writers, so that he may, by following the changing methods of interpretation as they appear in the authorities, learn not only what the law of partnership now is, but how it came to have its present status. There has been no attempt to make the citation of cases exhaustive upon well-estab lished propositions. But it is by no means meager. Nearly five thou sand cases being referred to in different parts of the work. Great pains has been taken in the citation of these cases to have them each exactly support the proposition to which it is cited. Long lists of cases have been avoided, and, as far as possible in a one-volume work on so extensive a subject, the cases have been classified in the notes and the specific points decided have been stated. It is believed that all the leading American and English cases are included. In citing statutes throughout the book, the last general revision in the several states has in each case been consulted. Book Synopsis Principles of the Law of Partnership (Classic Reprint) by : Arthur Underhill
Download or read book Principles of the Law of Partnership (Classic Reprint) written by Arthur Underhill and published by Forgotten Books. This book was released on 2016-08-30 with total page 208 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Principles of the Law of Partnership This Treatise makes no pretence to the position of a text book. It is merely a broad sketch giving the salient features Of the subject. For the finished picture, with its wealth of detail, the reader must turn to the elaborate work of Lord lindley. But although a sketch is necessarily a humble work, like other humble things it has its uses. By excluding complex details, it accentuates and brings into greater relief those principal features Of the landscape upon which its character depends. So in students' law books, if one can generalise the wilderness of single instances embalmed in the reports, and extract therefrom some broad principles - ii one can, as bacon puts it, rather excite the judgment brie y than inform it tediously - the work will not be altogether useless. For these reasons it is hoped that law students and commercial men may find in this little book a readable and concise, and it is believed an accurate View of the main principles of the law of partnerships. For the convenience of practitioners an Appendix has been added to this Edition, containing a print of the Partnerships Act, 1890. Need I make acknowledgment of my indebtedness to Lord lindley? It goes without saying. NO one whovi preface. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from A Treatise on the Law of Partnership In view of the general approval with which the first edi tion was received, the preparation of the second has involved little besides the presentation of the result of the recent de cisions. Every decision on the subject since the first edition was issued has been examined, and not only all that present novel applications of the law, but all that bear on unsettled questions, have been added. Moreover a considerable num ber of cumulative decisions, selected with special reference to their exhaustiveness of discussion, have been inserted. Few changes in the text have been found needful, but such as might clarify the statement and better present the results of recent holdings have been made. W. A. S. This being said, it is almost superfluous to say that I agree with him in thinking the Indian Codes a desirable model for the exposition of English law, by authority if possible, but if and so far as that is too much to hope for, then by private endeavor; and that I likewise agree with the reasons which he has given for that opinion, both in the intro duction to his Digest of the Law of Evidence and on various other occasions. Some of those reasons, however, I may, without presumption, try to restate in my own way, this being a topic on which repetition is certainly not vain in the sense of being needless; and it seems also proper, in addition to this general statement, to explain why the subject of Partnership appears to me a specially fit one for an experiment of this kind. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Partnership The body of rules which constitutes the modern law of partnership is a growth having its sources in the Common Law of England, the Civil Law of Rome and the Law Merchant. Its beginnings are Older than re corded history and traces of it are found among the most savage of tribes. Far beyond the confines of civiliza tion, among those who lead the rudest lives, such as hunters and trappers, its elemental principals are vaguely recognized and respected. A faint conception is found in forms of life lower than that of man, as when beasts of prey combine their courage, cunning, strength and instinct to share the dangers and rewards of the chase in order that these fierce partners of the wild may live and thrive. With the advance of civiliza tion and the higher specialization of modern life, the law of partnership has been amplified and perfected into that system of rules which govern the unincorporated busi ness associations of today. In England and in several of the American States the law of partnership has been codified. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
