Heather Selma Gregg argues that efforts to nation-build in both countries focused more on what should be called state-building, or how to establish a government, rule of law, security forces, and a viable economy. Considerably less attention was paid to what might truly be called nation-building--the process of developing a sense of shared identity, purpose, and destiny among a population within a state's borders and popular support for the state and its government. According to Gregg, efforts to stabilize states in the modern world require two key factors largely overlooked in Iraq and Afghanistan: popular involvement in the process of rebuilding the state that gives the population ownership of the process and its results and efforts to foster and strengthen national unity. Gregg offers a hypothetical look at how the United States and its allies could have used a population-centric approach to build viable states in Iraq and Afghanistan, focusing on initiatives that would have given the population buy-in and agency. Moving forward, Gregg proposes a six-step program for state and nation-building in the twenty-first century, stressing that these efforts are as much about how state-building is done as they are about specific goals or programs.

With a detailed overview of the contemporary practice of universal jurisdiction, it discerns three trends at work: pure universal jurisdiction, universal jurisdiction "plus", and non-use. It also argues that these disparities in practice should raise serious concerns as to the legitimacy and perceived legitimacy of such globalized justice. It then turns to a further consideration, that of globalized justice, precisely because it takes place far from the locus of the crime, and is therefore "externalized" and may fail to achieve many of its putative goals. In addition, this is a key assessment of civil accountability, through the use of the Alien Tort Claims Act in the United States. It details how the use of civil penalties may offer new avenues for redress, particularly with relation to group accountability, whether that of armed groups or of corporations. However, it balances this approach to accountability with recognition of certain flaws within externalized criminal accountability. This study also focuses on mixed tribunals, or other methods of internationalized justice as viable alternatives, which may avoid some of the problems with external justice, but are themselves far from perfect. Book excerpt: The drafters of the ICC’s founding document, the Rome Statute, foresaw what would become the main challenge to the Court’s legitimacy: that it could violate national sovereignty. To address this concern, the drafters added the principle of complementarity to the ICC’s jurisdiction, in that the Court’s province merely complements the exercise of jurisdiction by the domestic courts of the Statute’s member states. The ICC honours the authority of those states to conduct their own trials. However, if the principle of complementarity is to be applied, states must ensure that their own judicial systems and trials are consistent with international standards of independence and fairness. In addition, for complementarity to work, the ICC must be willing to actively support, embrace, and implement the principle. If the Court holds on too tightly to a self-aggrandising view of its role in promoting international justice, then it will lose all credibility in the eyes of nation states. Finally, the international community, in calling on states to address war crimes committed within their borders, must provide the financial, technical, and professional resources that many struggling states need in this endeavour. This book sets forth several innovative recommendations to fulfil these goals so as to make future domestic war crimes courts work more effectively.
