Book excerpt: Thoroughly updated and featuring 75 new entries, this monumental four-volume work illuminates past and present events associated with civil rights and civil liberties in the United States. This revised and expanded four-volume encyclopedia is unequaled for both the depth and breadth of its coverage. Some 650 entries address the full range of civil rights and liberties in America from the Colonial Era to the present. In addition to many updates of material from the first edition, the work offers 75 new entries about recent issues and events; among them, dozens of topics that are the subject of close scrutiny and heated debate in America today. There is coverage of controversial issues such as voter ID laws, the use of drones, transgender issues, immigration, human rights, and government surveillance. There is also expanded coverage of women's rights, gay rights/gay marriage, and Native American rights. Entries are enhanced by 42 primary documents that have shaped modern understanding of the extent and limitations of civil liberties in the United States, including landmark statutes, speeches, essays, court decisions, and founding documents of influential civil rights organizations. Designed as an up-to-date reference for students, scholars, and others interested in the expansive array of topics covered, the work will broaden readers' understanding of—and appreciation for—the people and events that secured civil rights guarantees and concepts in this country. At the same time, it will help readers better grasp the reasoning behind and ramifications of 21st-century developments like changing applications of Miranda Rights and government access to private Internet data. Maintaining an impartial stance throughout, the entries objectively explain the varied perspectives on these hot-button issues, allowing readers to draw their own conclusions.

Available in PDF, EPUB and Kindle. Book excerpt: Political factors influence judicial decisions. Arguments and input from lawyers and interest groups, the ebb and flow of public opinion, and especially the ideological and behavioral inclinations of the justices all combine to shape the development of constitutional doctrine. Drawing on political science as much as from legal studies, Constitutional Law for a Changing America: A Short Course helps you realize that Supreme Court cases are more than just legal names and citations. With meticulous revising, the authors streamline material while accounting for recent landmark cases and new scholarship. Ideal for a one semester course, the Eighth Edition of A Short Course offers all the hallmarks of the Rights and Powers volumes in a more condensed format. Students and instructors benefit from the online Con Law Resource Center which houses the supplemental case archive, links to CQ Press reference materials, a moot court simulation, instructor resources, and more.

Available in PDF, EPUB and Kindle. Book excerpt: The Voting Rights War tells the story of the courageous struggle to achieve voting equality through more than one hundred years of work by the NAACP at the Supreme Court. Readers take the journey for voting rights from slavery to the Plessy v. Ferguson case that legalized segregation in 1896 through today’s conflicts around voter suppression. The NAACP brought important cases to the Supreme Court that challenged obstacles to voting: grandfather clauses, all-White primaries, literacy tests, gerrymandering, vote dilution, felony disenfranchisement, and photo identification laws. This book highlights the challenges facing American voters, especially African Americans, the brave work of NAACP members, and the often contentious relationship between the NAACP and the Supreme Court. This book shows the human price paid for the right to vote and the intellectual stamina needed for each legal battle. The Voting Rights War follows conflicts on the ground and in the courtroom, from post-slavery voting rights and the formation of the NAACP to its ongoing work to gain a basic right guaranteed to every citizen. Whether through litigation, lobbying, or protest, the NAACP continues to play an unprecedented role in the battle for voting equality in America, fighting against prison gerrymandering, racial redistricting, the gutting of the Voting Rights Act, and more. The Voting Rights War highlights the NAACP’s powerful contribution and legacy.

Available in PDF, EPUB and Kindle. Book excerpt: Adherents of originalism often present it as a theory that constrains legal decision-making in a clear and objective manner that is based on the text and original meaning of the Constitution, in contrast to the supposedly subjective and “activist” jurisprudence of those who promote a living Constitution. But originalists have not had the same views on constitutional issues, calling into question the theory of originalism. Limits of Constraint examines the originalist jurisprudence of Hugo Black, Antonin Scalia, and Clarence Thomas, showing that three of the Court’s originalists have arrived at different conclusions in many constitutional areas. While the starkest contrast is between Justice Black and Justices Scalia and Thomas, even the latter two justices have disagreed on several key issues, including executive power and the administrative state. James Staab shows that originalism in actual practice does not deliver on its promise of an objective jurisprudence free of personal philosophy and discretion. Rather than rehash theoretical debates about the merits of originalism, Limits of Constraint examines originalism in operation by focusing on the judicial opinions of three prominent Supreme Court originalists: Hugo Black, Antonin Scalia, and Clarence Thomas. If the analysis of this book is correct—that is, the results reached by Justices Black, Scalia, and Thomas are divergent across a wide array of constitutional areas—then originalism promises more than it can deliver. One of the fundamental claims made by originalists is that their theory of constitutional interpretation limits judicial discretion, but originalism does not constrain judicial behavior as much as its defenders claim.
