Available in PDF, EPUB and Kindle. Book excerpt: Charity Law & Social Policy explores contemporary law, policy and practice in a range of modern common law nations in four parts and from the perspective of how this has evolved in the UK. As progenitor of a system bequeathed to its colonies and after centuries of leadership in developing the core principles, policies and precedents that subsequently shaped its development, the contribution of England & Wales, the originating jurisdiction, is first described and analysed in detail in Parts 1 and 2. These broadly sketch the parameters and role of ‘charity’ – seen as a mix of public and private interests - then address the law’s role in protecting, policing, adjusting and supporting charity. This provides the critical dimensions for the comparative analysis of experience in the common law nations that constitutes the main part of the book. Part 3, in 5 chapters, provides an analysis of the legal functions as they apply to type of need and thereby give effect to social policy in Singapore, Australia, New Zealand, Canada and the United States of America. Part 4 concludes with three chapters that appraise political influence as a factor in aligning charity law with social policy to create a facilitative environment for appropriate charitable activity. Attention is given to the central role of the regulator, contemporary charity law frameworks and definitional boundaries.

Available in PDF, EPUB and Kindle. Book excerpt: When disaster strikes, our instinctive response is to make things better, not only as individuals but also as groups, organisations, communities and major institutions within society. With increasing climate-related disasters and the potential for future global pandemics, philanthropy will continue to play an essential role. Yet our knowledge of how philanthropic responses to disasters are motivated, organised and received is fragmented. This book is a step toward curating our existing knowledge in the emerging field of ‘disaster philanthropy’ and to building a robust base for future research, practice and public policy. The authors highlight unknowns and ambiguities, extensions and unexplored spaces, and challenges and paradoxes. Above all, they recognise that philanthropic responses to disasters are complex, conditional and subject to change.

Available in PDF, EPUB and Kindle. Book excerpt: The Profits of Charity examines the contemporary law governing the involvement of charity in commerce, explores the reasons why this involvement is dramatically changing and considers the resulting implications for charities and the nonprofit sector. From a perspective familiar to charity lawyers, NGO managers, and scholars, Kerry O'Halloran identifies the concepts and the law underpinning charities and their profits by tracing legal developments in the field and identifying the resulting opportunities and challenges for the future. At a time when many leading nations are confronting economic recession, the threat of terrorism, and the retreat of the 'welfare state,' this book explores how and why governments are now turning to charities in their quest to cultivate social capital, consolidate civil society, and promote civic engagement. In The Profits of Charity, Professor O'Halloran undertakes a comparative analysis of the balance struck between government, charity, and commerce in the EU and leading common law nations, including the United States, Canada, England and Wales, New Zealand, and Australia. He uses analysis of legislation, outcomes of charity law reviews, and recent case law to illustrate jurisdictional differences, and concludes with an assessment of the extent and significance of the recalibrated relationships and considers the overarching issues that arise for charity law and social policy.

Available in PDF, EPUB and Kindle. Book excerpt: Throughout the nineteenth century poor relief in Quebec was private and sectarian. In Montreal bourgeois Protestant women responded by establishing institutional charities for destitute women and children. Their Benevolent Design delves into the inner workings of two of these charities (the Protestant Orphan Asylum and the Montreal Ladies’ Benevolent Society), sheds light on little-known aspects of the community’s response to social inequality, and examines the impact of liberalism on changing attitudes to poverty and charity. Seeing charity as a class duty, elite women structured their benevolent design around the protection, religious salvation, and social regulation of poor children. Janice Harvey explores how these philanthropists overcame the constraints of social conventions for women in polite society, how charity directors devised and implemented institutional aid, and how that aid was used by families and experienced by children. Following the development of the charities through the end of the nineteenth century and into the early twentieth, the book explores the conflict that arose between these institutions and other social services, including those that advocated for foster care and so-called scientific charity. The 1920s marked a major social shift in how child poverty was understood and managed in Protestant Montreal. Despite the gendered obstacles facing women in charity organization, Their Benevolent Design celebrates the remarkable ingenuity and independence of a group of Canadian women in shaping social aid and improving the grim realities of child poverty.

It includes summaries of the law underlying each of the parts and questions in the return, so that the preparer can understand the background law in formulating answers on the return. The subject matter is particularly timely and relevant given the release of the draft Form 990 last summer, the expected release of the final Form 990 in early 2008, and the commencement of the first tax year to which the form applies on January 1, 2008.
