Book excerpt: Since the horrific Tiananmen Square massacre in 1989, the debate on human rights in China has raged on with increasing volume and shifting context, but little real progress. In this provocative book, one of our most learned scholars of China moves beyond the political shouting match, informing and contextualizing this debate from a Confucian and a historical perspective. "Asian Values" is a concept advanced by some authoritarian regimes to differentiate an Asian model of development, supposedly based on Confucianism, from a Western model identified with individualism, liberal democracy, and human rights. Highlighting the philosophical development of Confucianism as well as the Chinese historical experience with community organization, constitutionalism, education, and women's rights, Wm. Theodore de Bary argues that while the Confucian sense of personhood differs in some respects from Western libertarian concepts of the individual, it is not incompatible with human rights, but could, rather, enhance them. De Bary also demonstrates that Confucian communitarianism has historically resisted state domination, and that human rights in China could be furthered by a genuine Confucian communitarianism that incorporates elements of Western civil society. With clarity and elegance, Asian Values and Human Rights broadens our perspective on the Chinese human rights debate.

This poses a challenge because of the strong bias of prevailing cultural systems in the region toward the goal of lifting standards of living over achieving ecological sustainability. This book juxtaposes international environmental norms and practices with relevant Asian policies and their applications in key areas. Roda Mushkat examines the fundamental principle of public participation in environmental law-making, as well as the "rights approach," against the emergence of democratic and human rights norms in the region. The complex relationship between trade and the environment is also discussed in light of the strong regional emphasis on economic growth, trade liberalization, and the aversion to conditionalities. Given regionalization processes in Asia-Pacific and elsewhere, this work seeks to establish to what extent such processes have led to the regionalization of international environmental law. International Environmental Law and Asian Values concludes that, although some gaps can be identified between international imperatives and regional responses, "Asian values" have not proved to be an insurmountable barrier to the spread of international environmental legal ideas. On the whole, the region is responding to impulses emanating from the global arena rather than resisting them consciously. The analysis and conclusions of this comprehensive and original work will be of considerable interest to scholars of international law and relations, environmental policy, comparative culture, economic development, and social change.

Recently, however, they have acknowledged that ecosystems cannot be understood without taking into account human interventions that may have taken place for thousands of years. And for their part, social scientists have recognized that human behavior must be understood in the environment in which it is acted out. Researchers have thus begun to develop the area of “human ecology.” Yet human ecology needs suitable conceptual frameworks to tie the human and natural together. In response, Cultural Values and Human Ecology uses the framework of cultural values to collect a set of highly diverse contributions to the field of human ecology. Values represent an important and essential aspect of the intellectual organization of a society, integrated into and ordained by the over-arching cosmological system, and constituting the meaningful basis for action, in terms of concreteness and abstraction of content as well as mutability and permanence. Because of this balance, values lend themselves to the kinds of analyses of ecological relationships conducted here, those that demand a reasonable amount of specificity as well as historical stability. The contributions to Cultural Values and Human Ecology are exceedingly diverse. They include abstract theoretical discussions and specific case studies, ranging across the landscape of Southeast Asia from the islands to southern China. They deal with hunting-gathering populations as well as peasants operating within contemporary nation-states, and they are the work of natural scientists, social scientists, and humanists of Western and Asian origin. Diversity in the backgrounds of the authors contributes most to the varied approaches to the theme of this volume, because differences in cultural background and academic tradition will lead to different research interests and to differences in the empirical approaches chosen to pursue given problems.

Book excerpt: Drawing on the core values of western civilization, the author refines the counterparts in Chinese civilization, summarized as four core principles: duty before freedom, obedience before rights, community before individual, and harmony before conflict. Focusing on guoxue or Sinology as the basis of his approach, the author provides detailed explanations of traditional Chinese values. Recent scholars have addressed the concept of guoxue since the modern age, sorting through it and piecing it together, which has produced an extremely abundant range of information. However, given that the concepts and theories involved have been left largely unanalyzed, this book develops a theoretical treatment of them in several important respects. First, it analyzes the mindset of guoxue, examining the dominant ideas and values of the era from which the term “guoxue” arose, focusing on its connection to early changes and trends in society and culture, and distinguishing three key phases of development. Past scholars mainly had in mind the range of objects studied in guoxue when defining it, and what this book underscores is the meaning of guoxue as a modern body of research. Secondly, it assesses several phases in the modern evolution of the body of guoxue research from the beginning to the end of the 20th century, i.e., ending with the later phase of the National Heritage movement. Third and lastly, the book explores the various main modes of modern guoxue, which correspond step by step with the evolutionary phases of guoxue research.
