Book excerpt: This edition of the book offers a comprehensive re-thinking of antitrust law, approaching competition problems in the market from a functional standpoint. The book has roots in prior editions, but it really offers a top-to-bottom reconsideration of how best to present modern issues in antitrust. After a brief introduction to the origins and objectives of antitrust law, the book launches the study of the field with a chapter on the concept of market power and the meaning of competition--building blocks that are essential to understanding everything else that follows in the course. It then devotes three chapters to the primary kinds of antitrust issues that arise from marketplace conduct: horizontal agreements among competitors, vertical distribution agreements, and exclusionary practices (whether done by a single firm or a group). Because of their importance to the economy, as well as to antitrust practice, mergers have their own chapter, which provides not only the important judicial opinions in this area, but also extensive materials from the Department of Justice and the Federal Trade Commission, the primary regulators of merger activity. The book then turns to two specialized issues that are of growing importance: the way in which U.S. antitrust laws operate in the global economy, and an innovative new chapter on intellectual property, technology, and platforms. It concludes with a chapter discussing the legal boundaries around the field of antitrust, including exemptions and immunities, and a chapter on the institutional framework for enforcement--the framework that translates words on a page into reality on the ground. The Seventh Edition retains and, where appropriate, adds to, the problems that have been a feature of this book for decades. To maximize instructor flexibility, the problems for each topic now appear at the end of the chapter.

Book excerpt: In the eight years since this major work's first edition, the field of antitrust law has seen enormous changes. The new Second Edition reflects this progress, discussing the latest debate over the policies underlying the antitrust laws and the procedures under which they operate. In addition, the basic antitrust coverage has been brought forward in the book to provide students with a background in the basic law before introducing more complex issues such as antitrust exemptions. Its readings use current, definitive cases in its coverage of concerted activities, vertical price restraints, monopolizing, international antitrust, administrative law, regulated industries, and more.

Book excerpt: The first chapter of this book provides an historical review of antitrust law in terms of the political and economic ideas which have shaped it throughout its development. In the successive chapters, the authors provide a sense of the manner in which changes in the underlying economic analysis have shaped the application of the statutes by the enforcement agencies and the courts. The authors have addressed the antitrust issues raised by recent changes in technology, in the rise of global markets, and in the structure of health care markets by devoting three separate chapters to Intellectual Property, International Trade, and Health Care. Author Commentaries throughout the book are designed to probe the doctrinal and policy issues raised by the case excerpts. In keeping with the objective of providing the economic analysis that may amplify and clarify the legal and policy issues, the authors have also taken into account recent trends in the relevant economic literature. Professors and adjunct professors may request complimentary examination copies of LexisNexis law school publications to consider for class adoption or recommendation. Available in PDF, EPUB and Kindle. Book excerpt: This innovative and popular casebook focuses on teaching antitrust through the best legal precedents available. It emphasizes current judicial opinions and includes dissents where relevant to help students grasp the issues. The notes reflect a balanced approach to the competing ideologies of left, right, and center--confronting their defects and presenting their strengths. Professors who are strongly committed to a particular ideology should find plenty of material to criticize or, alternatively, to illustrate their view. The ninth edition of the casebook is being published on the 40th anniversary of the publication of the inaugural edition of this leading antitrust casebook. Specific updates for this edition include: Updates on the cyclical nature of antitrust endorsement theories and trends, with a focus on the Biden administration, including a return to a progressive neo-Brandeis antimonopoly approach concerning increased economic power and its effect on concentration in the marketplace affecting consumers and workers and leading to inequality in society and ultimately democracy. Developments in the per se rule for price fixing, including labor cartels ("anti-poaching" agreements) and the possibility of criminal prosecution. Treatment of the AMG Capital Management case, narrowing the ability of the FTC to award monetary relief; and Axon Enterprises, which permitted courts to consider the status and protections of the FTC's administrative law judges. Discussing amendments to venue legislation that make it more difficult for actions brought by multiple state attorneys general to be transferred and consolidated. The Celestin and Blenheim decisions limiting the reach of the Act of State doctrine and expanding the scope of foreign sovereign immunity. Discussion of the Steve's case permitting a private plaintiff to obtain structural relief in a merger case. Discussion of the termination of the Paramount consent decree, which had imposed restrictions on distribution in the motion picture industry. Excerpt and discussion of Supreme Court's National Collegiate Athletic Association v. Alston opinion. Discussion of no-poach agreements as a form of market division. New note on antitrust and worker noncompete agreements, as well as the FTC's assertion of rule making authority to ban most such agreements. Discussion of the tying and exclusive dealing claims in the Epic Games v. Apple case, as well as other platform dominance cases. New note on the criminal prosecution of illegal monopolies.

It presents the eight U.S. Supreme Court antitrust cases decided since Trinko in 2004, which span almost all areas of antitrust law from resale price maintenance and tying to predatory buying, joint ventures, extraterritorial jurisdiction and the antitrust/regulation interface. As well, it presents contemporary merger and monopoly analysis and policy, and it contains sufficient substantive excerpts from the European Microsoft case to allow an appreciation of the US/EU fault lines.
