The first edition of this book was written during 2003 and 2004. There were no High Court (or higher) decisions interpreting the provisions of the new Act and there were no decisions of IPONZ (Intellectual Property Office of New Zealand). Accordingly, there were no useful guidelines in difficult areas of the law and practice. This new edition brings the book up-to-date by including decisions made under the new regime. In addition, there have been some small, but important, amendments made to the Act since its enactment. For example, the Trade Marks Amendment Act 2005 altered sections 17 and 32 (inserting the words "claiming to be the owner" into section 32 and making section 17 clearer). There was also a change to the parallel importation section 97A by the Copyright (Parallel Importation of Films and Onus of Proof) Amendment Act 2003, section 5.
